Article 5: Uses 40 <br /> Section 5.10: Standards for Telecommunication Facilities <br /> (F) Procedure <br /> All applications for telecommunication facilities that are eligible for administrative <br /> approval shall be submitted and reviewed in accordance with the standards of Section <br /> 5.10.3 of this Ordinance. <br /> (1) A written decision approving or denying an application for administrative approval <br /> of a telecommunication facility under this section shall be issued no later than 45 <br /> days following the submission of a complete application. <br /> (2) If the Planning Director denies the application, the reasons for such a decision <br /> shall be stated in writing to the applicant. <br /> 5.10.5 Standards and Procedures for Small and Micro-Wireless Facilities <br /> (A) An applicant may file a single consolidated application for up to 25 separate small or <br /> micro-wireless facilities at one time, but the County may choose to issue separate <br /> decisions on one or more of the facilities included within a consolidated application. <br /> (B) Timeframe for review <br /> Applications for the establishment of a small/micro wireless facility shall be processed <br /> and decided within 45 days from the date the application is determined to be complete. <br /> Nothing shall prohibit the County and the applicant from mutually agreeing to a longer <br /> review period. <br /> (1) If an application is denied, the County will send a written explanation of the <br /> reasons for denial no later than the date of denial. The applicant may cure the <br /> deficiencies and submit the revised application within 30 days of the initial denial. <br /> The application will be deemed complete on resubmission if the application <br /> materials cure the deficiencies. [See N.C. Gen. Stat. § 160D-933 (d)(3).1 <br /> (C) Timing for operation <br /> Construction of a small/micro wireless facility shall commence within six (6) months of its <br /> approval and the small wireless facility shall be activated for use within one (1) year from <br /> the permit issuance date, unless delayed by a lack of commercial power at the site. <br /> (D) Maximum equipment size <br /> (1) In no instance shall a small or micro wireless facility exceed the following <br /> maximum size limitations found in the definition; a small or micro wireless facility <br /> that exceeds these maximum size limitations shall be reviewed as a wireless <br /> communications facility. <br /> (2) Micro wireless facilities shall be no larger in dimension than 24 inches in length, <br /> 15 inches in width, and 12 inches in heiqht and that has an exterior antenna, if <br /> any, no longer than 11 inches. <br /> (3) The antenna(s) of small wireless facilities shall be located inside an enclosure of <br /> no more than 6 cubic feet in volume or, in the case of an antenna that has <br /> exposed elements, the antenna and all of its exposed elements, if enclosed, <br /> could fit within an enclosure of no more than 6 cubic feet. All other wireless <br /> equipment associated with the facility shall have a cumulative volume of no more <br /> than 28 cubic feet. <br /> (a) The following types of ancillary equipment are not included in the <br /> calculation of equipment volume, as discussed herein: electric meters, <br /> concealment elements, telecommunications demarcation boxes, ground- <br /> based enclosures, grounding equipment, power transfer switches, cut-off <br /> switches, vertical cable runs for the connection of power and other <br /> services, or other support structures. <br /> Orange County, North Carolina—Unified Development Ordinance Page 5-98 <br />
