Article 5: Uses 35 <br /> Section 5.10: Standards for Telecommunication Facilities <br /> (b) If the wireless support structure is proposed as an accessory use to a <br /> residential use, the setback shall be 110% of the wireless support <br /> structure height from any residence or dwelling unit on the subject <br /> propertV. <br /> (c) Adjacent to non-residential uses or non-residential zoning districts, <br /> minimum setbacks from the base of the wireless support structure to the <br /> property boundary shall be the greater of 20% of the tower height, or the <br /> minimum required setback. <br /> (d) All stealth towers, buildings and other structures to be located on the <br /> same zoning lot as a wireless support structure shall conform with the <br /> setbacks established for the zoning district or as established through the <br /> subdivision process, whichever is greater. <br /> (5) Landscape Plan. A Landscape Plan meeting the requirements of Section 6.8 is <br /> required. <br /> (F) A statement evidencing compliance with federal and state regulations. All wireless <br /> telecommunication facilities shall comply with or exceed current standards and <br /> regulations of the Federal Aviation Administration (FAA), the Federal Communications <br /> Commission (FCC), and any other agency of the federal government that regulates <br /> telecommunications facilities. A copy of the FCC license applicable for the intended use <br /> of the facility as well as a copy of the 5 and 10- year building out plan required by the <br /> FCC is required. In addition to federal requirements, all wireless telecommunication <br /> facilities shall comply with or exceed current standards and regulations of N.C. Gen. Stat. <br /> M160D-930 through 160D-936. <br /> (G) Accessory equipment <br /> An Itemization of all accessory equipment, including any buildings, cabinets, or shelters, <br /> shall be used only for the purpose of housing wireless telecommunications equipment <br /> and other supplies in direct support of the operation of the wireless telecommunications <br /> facility. Any equipment or materials not used in direct support of such an operation shall <br /> not be stored on the site. <br /> (H) Lighting Plan <br /> A lighting Plan in accordance with section 6.11 is required with the following additional <br /> prevailing standard: <br /> (1) Lighting of a wireless support structure is limited to that required for compliance <br /> with FAA minimum standards. Any lighting required by the FAA must be of the <br /> minimum intensity and duration. FAA-required lighting shall be designed so that <br /> it is not visible from the ground, to the extent permitted by FAA regulations. <br /> (1) Signage. "High Voltage," "No Trespassing" and Other Signs <br /> (1) If high voltage is necessary for the operation of the telecommunications facility or <br /> any accessory structures, "HIGH VOLTAGE - DANGER"warning signs shall be <br /> permanently attached to the fence or wall and shall be spaced no more than 40 <br /> feet apart. <br /> (2) The warning signs may be attached to freestanding poles if the content of the <br /> signs would, or could, be obstructed by landscaping. Signs noting federal <br /> registration (if required) shall be attached to the tower structure in compliance <br /> with federal regulation. <br /> (3) The letters for the "HIGH VOLTAGE - DANGER" and "NO TRESPASSING" <br /> warning signs shall be at least six inches in height. <br /> (a) The two warning signs may be combined into one sign. <br /> (b) All warning signs shall be installed at least five feet above the finished <br /> grade of the fence. <br /> Orange County, North Carolina—Unified Development Ordinance Page 5-93 <br />
