Page 45 of 53 <br />5-2-25 <br /> <br />provisions, nor reduce the obligations of the CMAR to maintain such insurance or to meet its <br />obligations under the indemnification provisions. <br />The CMAR shall provide the Owner a valid certificate of insurance, in advance of the <br />performance of any work, exhibiting coverage as required by the Owner. Providing and <br />maintaining adequate insurance coverage is a material obligation of the CMAR. CMAR shall <br />require its subcontractors to maintain insurance coverage required herein or cover the <br />subcontractors’ under the CMAR’s policies. The Certificate of Insurance shall be provided on the <br />industry standard form, ACORD 25. <br />Notwithstanding the foregoing, nothing contained in this section shall be deemed to constitute a <br />waiver of the governmental immunity of Orange County, which immunity is hereby reserved to <br />Orange County. <br />The Work under this Contract shall not commence until the CMAR has verified to the Owner that <br />all required insurance coverage as described herein has been obtained and verifying certificates of <br /> insurance have been approved in writing by the Owner. These certificates shall contain a provision <br /> that coverage afforded under the policies will not be cancelled, reduced in amount, or coverage <br /> eliminated until at least thirty (30) days after mailing written notice, by certified mail, return <br />receipt requested, to the insured and the Owner of such alteration or cancellation. <br /> Insurances to be provided are as follows: <br /> <br />47.1.1. Commercial General Liability: The CMAR shall ensure that it and all Subcontractors <br />shall provide commercial general liability insurance with a limit of not less than <br />$5,000,000 per occurrence and $10,000,000 aggregate. Coverage must be in a form <br />providing coverage not less than the standard Insurance Services Office Form CG 00 01 <br />and include products and completed operations, property damage, bodily injury, and <br />personal & advertising injury. The products-completed operations coverage shall be <br />provided for a minimum of six (6) years following final acceptance of the work. <br />47.1.2. Commercial Automobile Liability: The CMAR shall ensure that it and all <br />Subcontractors shall provide commercial automobile liability insurance of not less than $2,000,000 <br />per occurrence for any vehicle. <br /> <br />47.1.3. Worker’s Compensation and Employer’s Liability: The CMAR shall ensure that it and <br />all Subcontractors provide and maintain, during the life of the Contract, worker’s compensation <br /> insurance, as required by law, as well as employer’s liability coverage, with minimum limits of <br /> $1,000,000 per accident for bodily injury of disease. <br /> <br />47.1.4. Professional Liability: The CMAR shall ensure that it and all professional service <br />providers under this contract provide professional liability insurance with a limited of not less than <br />$5,000,000 per occurrence or claim, and $5,000,000 aggregate. There shall be an extended <br />reporting period of not less than six (6) years. <br /> <br />47.1.5. Builders Risk: Builder’s Risk: The CMAR shall ensure that it and all Subcontractors <br />purchase and maintain property insurance during the life of this Contract, upon the entire Work at <br />the site in amount equal to the completed value of the project with no coinsurance penalty <br />provisions utilizing an “All Risk” (Special Perils) coverage form. This insurance shall include the <br />interests of the Owner, the CMAR, the Subcontractors and sub-subcontractors in the Work and <br />shall insure against the perils of fire, extended coverage, and vandalism and malicious mischief. If <br />the Owner is damaged by failure of the CMAR to purchase or maintain such insurance, then the <br />CMAR shall bear all reasonable costs properly attributable thereto; the CMAR shall effect and <br />maintain similar property insurance on portions of the Work stored off the site when request for <br />payment per articles so includes such portions. <br /> <br />Docusign Envelope ID: 5A9E3BC2-EAE1-4C35-82D9-B4D6A375FA78
