At the completion of the Project and before final payment, the CMAR shall deliver a complete set <br />of as-built drawings for use by the Project Designer in preparing Record Drawings. <br />31. COST CONTROL <br /> <br />31.1. The CMAR shall develop and maintain an effective system of Project cost control. Elements of the <br />system of Project cost control will include Project budgets, GMP proposals, the critical path <br />schedule, and cash flow forecasts and reports, all in formats to be approved by the Owner. <br />31.2. The CMAR shall incorporate into each element of the system of Project cost control all Owner <br />approvas they occur, update and refine the GMP, and develop reports and forecasts as needed, or as <br />directed by the Owner. The CMAR shall identify variances between actual and estimated costs and <br />advise the Owner whenever projected cost exceeds allowances or estimates. <br />31.3. The CMAR shall check and supervise all material deliveries, equipment and labor entering the <br />Work site. The CMAR shall maintain cost accounting records on authorized Work performed under <br />unit costs, actual costs for labor and material, or other bases requiring accounting records, and <br />afford the Owner access to these records and preserve them for a period of three (3) years after <br />final payment. The Owner reserves the right to audit these records during that period. <br />32. CHANGES IN THE WORK <br /> <br />32.1. The CMAR shall develop and implement a system for review, negotiation, and processing of <br />proposed Change Orders. The CMAR shall, with complete supporting data, recommend necessary <br />desirable changes to the Owner and the Project Designer for approval. <br />32.2. The Owner unilaterally at any time may have changes made in the Work covered by the Contract, <br />including but not limited to changes: (1) in the specifications or drawings; (2) in the sequence, <br />method or manner of performance of the Work; (3) in the Owner-furnished facilities, equipment, <br />materials, services or site; or (4) directing acceleration in the performance of the Work. <br />Furthermore, it is understood and agreed that refinement and detailing may be accomplished from <br />time to time with respect to the drawings and specifications. The CMAR’s entitlement to an <br />increase in the GMP or an extension of time, or both, if any, for such changes shall be determined <br />in accordance with this Contract. <br /> <br />32.3. No adjustment in the Guaranteed Maximum Price or the Scheduled Completion Date shall be made <br />unless such change, refinement or detailing results in changes in the scope and/or design of the <br />Project, or as otherwise required under the Contract Documents, as reasonably determined by the <br />Owner. <br /> <br />32.4. The Owner’s Representative has the authority to order minor changes in the Work not involving an <br />adjustment in the GMP or time for completion, and not inconsistent with the intent of the <br />Construction Documents. Such changes shall be effected by written order and shall be binding on <br />the Owner and the CMAR. The CMAR shall not perform any changes in the Work unless <br />authorized in writing by the Owner. The CMAR’s performance of minor changes pursuant to this <br />section shall not constitute a waiver of any claim the CMAR may have for additional compensation <br />or time. Any claim the CMAR may have, however, shall be filed in strict conformance with this <br />Contract. <br /> <br />32.5. No Change Order will be issued for resolution of conflicts in the documents which are to be <br />covered by the CMAR-GMP Contingency. <br /> <br />32.6. Except in an emergency endangering life or property, no change shall be made by the CMAR <br />except upon receipt of approved change order or written field order from the Project Designer, <br />countersigned by the Owner’s representative authorizing such change. No claim for increases in the <br />GMP shall be honored or valid unless this procedure is followed. A field order, transmitted by fax <br />or hand-delivered, may be used where the change involved impacts the critical path of the Work.
