The CMAR shall arrange for and submit monthly to the Owner and Project Designer, as a General <br />Conditions expense, progress photographs, organized by date into a sequentially labeled, three ring <br />binders or approved electronic equivalent, in sufficient detail to properly record the Work. <br />8. CODES AND STANDARDS <br /> <br />8.1. Wherever reference is given to codes, standard specifications or other data published by regulating <br />agencies including, but not limited to, national electrical codes, North Carolina state building <br />codes, federal specifications, ASTM specifications, various institute specifications, etc., it shall be <br />understood that such reference is to the latest edition including addenda published prior to the date <br />of the Contract Documents. <br /> <br />9. LABOR, MATERIALS AND EQUIPMENT <br /> <br />9.1. The CMAR shall, unless otherwise specified, contract for and pay for all labor, transportation, <br />materials, tools, construction apparatus, lights, power distribution, generators, heating apparatus, <br />sanitary facilities, water distribution, safety equipment, scaffolding and incidentals necessary for <br />the completion of the Work, shall arrange for the installation, maintenance and removal all <br />construction equipment, utensils or things, and be responsible for the safe, proper and lawful <br />construction, maintenance and use of same, and the CMAR shall construct in the best and most <br />workmanlike manner, a complete Project and everything incidental thereto, as shown on the <br />drawings, stated in the specifications, or reasonably inferable there from, all in accordance with the <br />Contract Documents. <br /> <br />9.2. All materials shall be new and of quality specified, except where reclaimed material is authorized <br />herein and approved for use. Workmanship shall at all times be of a grade accepted as the best <br />practice of the particular trade involved, and as stipulated in written standards of recognized <br />organizations or institutes of the respective trades except as exceeded or qualified by the <br />specifications. <br /> <br />9.3. As set forth in the Construction Documents or upon reasonable notice from the Owner’s <br />Representative, the CMAR shall require the Subcontractors to furnish warranties and evidence as to <br />quality of materials. <br /> <br />9.4. Products are generally specified by the American Society for Testing and Materials (“ASTM”) or <br />other reference standard and/or by manufacturer’s name and model number or trade name. When <br />specified only by reference standard, the CMAR may select any product meeting this standard, by <br />any manufacturer. When several products or manufacturers are specified as being equally <br />acceptable, the CMAR has the option of using any product and manufacturer combination listed. <br />However, the CMAR shall be aware that the cited examples are used only to denote the quality <br />standard of the product desired and that they do not restrict bidders to a specific brand, make, <br />manufacturer or specific name; that they are used only to set forth and convey to bidders the <br />general style, type, character and quality of product desired; and that equivalent products will be <br />acceptable. Request for substitution of materials, items, or equipment shall be submitted to the <br />Project Designer for approval or disapproval; such approval or disapproval shall be made by the <br />Project Designer prior to the opening of bids. <br /> <br />9.5. The CMAR shall obtain written approval from the Project Designer for the use of products, <br />materials, equipment, assemblies or installation methods claimed as equal to those specified. Such <br />approvals must be obtained as soon after contract awards as possible and before any materials are <br />ordered. <br /> <br />9.6.
