Based on the Project Designer’s inspections and evaluations of the Project, the Project Designer <br />shall issue interpretations, directives, and decisions as may be necessary to assist the CMAR in the <br />administration of the Project. The Project Designer’s decisions relating to artistic effect and <br />technical matters shall be final, provided such decisions are within the limitations of the Contract. <br />The CMAR’s decisions, however, relating to means and methods, and administration of the <br />contracts the CMAR holds are final. <br />7.DRAWINGS, SPECIFICATIONS AND RECORD DOCUMENTS <br />7.1. All data, information, material and matter of any nature and all copies thereof in any and all forms <br />whatsoever developed by the CMAR or in the CMAR’s possession or control relating to the Project <br />are the property of the Owner and shall be turned over to the Owner within ten (10) days after the <br />Owner’s request. CMAR may, however, retain in the files of its legal counsel solely for archival <br />purposes, one copy of the same so as to provide a record thereof. <br />7.2. All design drawings and specifications are instruments of service and remain the property of the <br />Owner. The use of these instruments on Work other than this contract without permission of the <br />Owner is prohibited. All copies of drawings and specifications other than contract copies shall be <br />returned to the Owner upon request after completion of the Work or in the event of a termination of <br />the Contract by either party. <br />7.3 Owner will bear the reasonable cost of reproduction and distribution of drawings, sketches, <br />specifications and other Construction Documents for use on the project development and by the <br />CMAR and its Subcontractors for bidding and administrative purposes, up to an allowance of <br />$TBD. The CMAR shall receive clean sets of black line prints on white paper of all drawings <br />provided by the Owner, the CMAR shall clearly and legibly record in redline all work-in-place that <br />is at variance with the Contract Documents. <br />7.4. In such cases where the nature of the Work requires clarification by the Project Designer, such <br />clarification shall be furnished by the Project Designer with reasonable promptness by means of <br />written instructions or detail drawings, or both. Clarifications and drawings shall be consistent with <br />the intent of Construction Documents, and shall become a part thereof unless objected to by the <br />Owner’s representative. <br />7.5. The CMAR shall maintain, in readable condition at its job office, one complete set of working <br />drawings and specifications for its Work, including all shop drawings. Such drawings and <br />specifications shall be available for use by the Project Designer or its authorized representative. <br />7.6. The CMAR shall require all Subcontractors to provide and CMAR shall maintain in a fire proof <br />safe at the job office a day-to-day record of “as built” work-in-place that is at variance with the <br />Contract Documents. Such variations shall be compiled by and fully noted on Project drawings by <br />the CMAR and submitted to the Project Designer upon Project completion and no later than 30 <br />days after acceptance of the Project. A condition of final payment to the CMAR shall be delivery to <br />the Project Designer, in paper, digital image and/or electronic form, each Subcontractor’s submittal <br />drawings and as-built records, and certification by the Project Designer that it has the information <br />needed to prepare a comprehensive as-built record of the Project for delivery to the Owner in <br />accordance with the Project Designer’s contract. <br />7.7. The CMAR shall devise, implement and maintain at the Project site, on a current basis, a structured <br />document control system which includes and tracks records of all necessary contracts, RFI’s, shop <br />drawings, samples, purchases, materials, equipment, maintenance and operating manuals and <br />instructions, and any other documents and revisions thereto which arise out of the Contract or the <br />Work.
