Based on the submitted materials, the project could meet the basic Erosion and <br /> Sedimentation Control requirements as required by Orange County UDO Section 6.15 <br /> and could be developed as generally proposed. With public monies being associated with <br /> the project the Department of Environmental Quality would be the reviewer for the Erosion <br /> Control component if the disturbance is one acre or greater. <br /> Stormwater Management: <br /> There were no new stormwater management related materials included in the submitted <br /> Rezoning Application. The submitted materials note that stormwater management for the <br /> proposed Outdoor Agricultural Lab has already been provided for the project via the <br /> previous construction of a bioretention cell on the north end of the project site. Orange <br /> County has confirmed records of the review and approval of the existing bioretention cell <br /> (i.e., Bioretention Cell #1) via legacy permit number LDP20-0046. Orange County staff <br /> does not; however, have any records related to the required recordation of an <br /> Operation & Maintenance (O&M) Agreement, the recordation of any required <br /> stormwater access/maintenance easements, the submission of sealed As-Builts, <br /> and/or the submission of an Engineer's Certification Letter for the existing <br /> bioretention cell. Oran--ge County staff will be contacting the owner/applicant <br /> and/or the engineer or record (CRA Associates, Inc.) to inquire as to the status of <br /> these required stormwater management related documents as such. <br /> Inasmuch, the submitted materials indicate a level of development that meet current UDO <br /> requirements specific to stormwater management. The project will need to meet <br /> applicable stormwater management requirements as outlined in Section 6.14 of the <br /> Orange County UDO and must be in general conformance with the North Carolina <br /> Stormwater Design Manual (i.e., Minimum Design Criteria). <br /> Conclusion: <br /> The Division has No Objections to the approval of the Rezoning Application so long as a <br /> complete LDP and/or SWP application and supporting plans and calculations are <br /> submitted for review, processing, and approval prior to commencement of any on-site <br /> Land-Disturbing Activity.
