<br />Members present: Chairman Harvey D. Bennett, Commissioners Gordon B. Cleveland, William C.
<br />Ray, Henry S. lvalker and Carl M. Smith.

<br />The principal purpose of this meeting was to hear budget presentations from the District
<br />Health Department and the Orange County Welfare Director.
<br />The County Administrator advised the Soard of the termination by the U. S. Army of its
<br />lease on a communication site atop the "mountain" south of Hillsborough. As requested by the
<br />Department of the AnTV, Chairman Bennett signed an acknowledgement of this termination notice which
<br />was returned to the Armq Carps of Engineers. The Board voiced no objections to the Army's disposing
<br />of their permanent improvements at this site to the N. C. Department of Conservation and Development.
<br />Tipon motion of Co^umissioner Smith, seconded by Commissioner Cleveland, and unanimously adopted
<br />the following interim appropriations resolution is to become effective July 1, 1965: That each
<br />department or agency of county government spendin.. county funds be authorized to expend an amount not
<br />exceeding 1/12 of their 196L--1965 appropriation between July 1,1965 and the day the 1965--1966 budget
<br />is finallyadopted.
<br />Commissioner Smith presented to the Board the following proposed agreement between the
<br />Research Triangle Regional Planning Commission and Orange County concerning the preservation of
<br />open space
<br />"This intergovernmental 4=-_ rent, made and entered into this day of

<br />cities, =counties or other public bodies hereinafter referred to as 'Public 3odies.'

<br />"4FHEEREAS, the Public Bodies are authorized by law to exercise responsibilities for the pre-
<br />servation of Open-Space land in the Research Triangle Region through the acquisition by gift of,
<br />purchase of, or by condemnation of title to or other permanent interest in, undeveloped or predomi-
<br />nantly undeveloped OpenSnace land which has value for park and recreational purposes, for the
<br />conservation of land and other natural resources, or for historic or scenic purposes;
<br />"VREREAS, the Research Triangle Regional Planning Commission charged by law with making and
<br />adopting a regional. plan for the physical develoment of the territory within the urban area, com-
<br />prising Durham, Grange, and Wake Counties, in the State of North Carolina, which plan must be made
<br />with the general purpose of guiding and accomplishing a coordinated, adjusted, and harmonious develop-
<br />ment of the Research Triangle Region;
<br />"W'IEREAS, the parties to this Intergovernmental Agreement are fully cognizant of the urgency
<br />of the need to expedite the process of acquiring Open-Space Land in accordance with an orderly cooper-
<br />ative plan, and recognize the importance of joint and combined efforts on the part of local govern-
<br />ments of the area in the provision of Open-Space' Land in accordance with an area-wide plan therefor;
<br />"NOM, TREREFORE, AGREaMXT WITNESSETH, that the Research Triangle Regional Planning Commission
<br />and each Public Body do agree as follows:
<br />1. As a basis for programs for the acquisition of title to, or other permanent interests in,
<br />land to be used as Open-Space Land, the Public Bodies hereto have made, subscribed to, and endorsed
<br />a General Development Plan, identified as 1980 General Development Plan, which plan is a compre-
<br />hensive land-use plan for the entire Research Triangle Region.
<br />2. The Public bodies will acquire Open-Space Land within their respective jurisdictions
<br />in accordance with this regional plan as identified in 1 above, amendments thereto or modifications
<br />thereof as may be agreed on from time to time by the parties hereto, and will use their best efforts
<br />to increase their Open-Space Land Acquisition Program in proportion to any grants received under the
<br />Federal Open-Space Land Program.
<br />3. The Public Bodies will provide funds for such acquisition within their respective juris-
<br />diction as needed.
<br />4. In order th assure that individual acquisitions are in accordance with the regional plan
<br />and with any approved amendments thereto, each Public Body, prior to final acquisition action on land
<br />to be used for open space purposes, or prior to the acquisition of land which is to be the subject
<br />of an anplication for Title VII assistance, will subnit desceiptions of proposed acquisitions to the
<br />Research Triangle Regional Planning Commission for review. The Public Bodies further agree to be
<br />guided by the review of the Research Triangle Regional Plan ing Commission in Proceeding with the
<br />acquisition of open-space lands.
<br />5. Nothing herein contained is intended to require a Public Body to take any action which
<br />it is not authorized to take, or to refrain from taking any action which it is required to take,
<br />pursuant to the State or local law under which such Public Body is created or under which it exercises
<br />responsibilities for the preservation of Open-Space Land.
