Orange County Solid Waste <br />Scalehouse Building 00 21 13 -2 INSTRUCTIONS TO BIDDERS <br />E.No bid may be withdrawn after receipt of Bids for a period of ​60​days. <br />1.3 ACCEPTANCE OF BID (AWARD) <br />A.It is the intention of the Owner to award a contract for work under this project to the <br />lowest responsible Bidder;however,in the interest of suitability to the need of the Owner <br />and/or economy,equipment,materials and furnishings other than the lowest in price may <br />be selected. <br />B.The Owner reserves the right to reject any or all Bids,to accept any bid submitted,to <br />waive any formalities,and to negotiate with the low Bidder or Bidders any changes <br />considered necessary or desirable. The Owner reserves the right to reject any Bid when <br />such rejection is in the interest of the Owner to reject the bid of the bidder who has <br />previously failed to perform or to complete on time Contracts of a similar nature;and to <br />reject the bid of a bidder who is not,in the opinion of the Engineer,in a position to <br />perform the Contract. <br />C.The Owner shall have the right to accept Alternates in any order or combination,unless <br />otherwise specifically provided in the Bidding Documents,and to determine the low <br />Bidder on the basis of the sum of the Base Bid and Alternates accepted. Alternates may <br />be accepted at any time during the bid holding period. <br />1.4 PRE-BID MEETING <br />A.Refer to the invitaiton or adveristement for bids for the date,time and location of the Pre- <br />Bid Meeting. <br />B.A Pre-Bid Meeting will be held for purposes of considering questions posed by Bidders. <br /> All interpretations and corrections to Contract Documents deriving from this meeting will <br />be documented via Addendum. <br />C.If the Bidder does not attend the Pre-Bid Meeting,it is the Bidder's responsibility to obtain <br />the Pre-Bid Meeting Minutes and all Addenda. <br />1.5 DISQUALIFICATION <br />A.The Owner reserves the right to disqualify Bids,before or after opening,upon evidence of <br />collusion with intent to defraud or commit other illegal practices upon the part of the <br />Bidder. <br />1.6 CONTRACTOR'S LICENSE <br />A.All Bidders must have proper licenses for contractors as required by State Law. The <br />Bidder's license number shall be listed on the bid form and on the outside of the inner <br />sealed envelope in which the bid is submitted. <br />1.7 CONFLICT OF INTEREST <br />A.Bidders must disclose in writing with their bid the name of any owner,officer,director,or <br />agent who is also an employee of the Owner. <br />B.Bidders must disclose in writing with their bid the name of any employee of the Owner <br />who owns,directly or indirectly,an interest of 5 percent or more in the Bidder’s firm or <br />any of its branches or subsidiaries. <br />Docusign Envelope ID: FA2D0569-6BCE-4E38-B3EE-9B3EFD09A753
