Orange County Solid Waste <br />Scalehouse Building 00 73 00 -5 SUPPLEMENTARY <br />CONDITIONS <br />D.9.9.1:Replace with:"The Owner may occupy premises and maintain normal building <br />functions during the contract period.Contractor will cooperate with Owner to minimize <br />conflict and facilitate Owner's operations.Safety of building occupants is of primary <br />importance.Any areas subject to hazard and/or falling material/debris to be barricaded to <br />prevent access." <br />E.9.9.2:Delete in its entirety. <br />F.9.9.3:Delete in its entirety. <br />G.9.10.1:Add to the end of the paragraph:"The Engineer will perform no more than one (1) <br />inspection to determine whether the Work has attained Final Completion in accordance <br />with the Contract Documents.The Owner is entitled to reimbursement (in the form of a <br />deductive change order)from the Contractor for amounts paid to the Engineer for any <br />additional inspections." <br />H.Add:"9.10.2.1The final payment of retained amount due the Contractor shall not become <br />due until the Contractor has furnished to Owner through the Engineer an affidavit signed, <br />sworn and notarized to the effect that all payments for materials,services,or any other <br />reason in connection with the Contract have been satisfied and no claims or liens exist <br />against the Contractor in connection with this Contract. If the Contractor and Owner form <br />possible liens or claims against the sub-contractor,the Contractor shall state in an <br />affidavit that no claim or liens exist against any subcontractor to the best of the <br />Contractor's knowledge,and if any appear afterwards the Contractor shall save the <br />Owner harmless on account thereof. The forms to be used shall be AIA Document G706 <br />and G706A,current editions.
