Orange County Solid Waste <br />Scalehouse Building 00 73 00 -4 SUPPLEMENTARY <br />CONDITIONS <br />c.March:11 days <br />d.April:8 days <br />e.May:9 days <br />f.June:9 days <br />g.July:11 days <br />h.August:9 days <br />i.September:7 days <br />j.October:6 days <br />k.November:7 days <br />l.December:9 days <br />2.8.3.1.2 The Owner will be flexible when considering adverse weather days which <br />will not permit the Contractor to pursue the work.For the Owner's consideration, <br />a letter documenting the number of days of inclement weather that occurred <br />during the preceding month shall be submitted by the Contractor with his monthly <br />application for payment.Failure to submit the request with the monthly <br />application will result in rejection of any consideration for the number of days the <br />preceding month." <br />B.Add: <br />1."8.4 Liquidated Damages: <br />a.8.4.1 If the Contractor has not substantially completed the work within <br />the specified contract time period and no time extensions have been <br />granted,the contract amount shall be reduced by the sum of five <br />hundred ($500)dollars per day for each day in excess of the scheduled <br />date of completion.Deductions from the original contract amount will be <br />documented in the form of a Change Order. <br />b.8.4.2 Refer to Specification Section 01 77 00 -Closeout Procedures for <br />liquidated damages for punch list items and closeout documents." <br />3.9 ARTICLE 9 -PAYMENTS AND COMPLETION <br />A.9.7 Delete in its entirety. <br />B.9.8.1:Replace with:"Substantial Completion shall be defined as a finished job where all <br />phases of construction,installation,and clean-up are fully completed and ready for <br />substantial completion inspection so that the Owner can occupy or utilize the work for its <br />intended use" <br />C.9.8.3:Add to the end of the paragraph:"The Engineer will perform no more than one (1) <br />inspection to determine whether the Work has attained Substantial Completion in <br />accordance with the Contract Documents.The Owner is entitled to reimbursement (in the <br />form of a deductive change order)from the Contractor for amounts paid to the Engineer <br />for any additional inspections." <br />Docusign Envelope ID: FA2D0569-6BCE-4E38-B3EE-9B3EFD09A753
