Orange County Solid Waste <br />Scalehouse Building 00 73 00 -2 SUPPLEMENTARY <br />CONDITIONS <br />C.Add: <br />1."3.2.5 The Owner is entitled to reimbursement (in the form of reduced contract <br />amount)from the Contractor for amounts paid to the Engineer for evaluating and <br />responding to the Contractor's requests for information that are not prepared in <br />accordance with the Contract Documents or where the requested information is <br />available to the Contractor from a careful study and comparison of the Contract <br />Documents,field conditions,other Owner-provided information,Contractor- <br />prepared coordination drawings,or prior Project correspondence or <br />documentation. <br />2.3.2.6 Should a difference occur in or between the drawings or specifications, <br />between divisions or sections or between details on the drawings,the Contractor <br />shall be deemed to have estimated the more expensive product or method <br />indicated,unless he shall have asked for and obtained a decision in writing from <br />the Engineer for submission of proposals as to which product or method shall be <br />required." <br />D.3.7.4:First Sentence:change "14 days"to read "48 hours". <br />E.3.8.1:Second sentence:add the words "and Engineer"between "Owner"and "may". <br />F.3.12.9:Delete the word "approval"in the second sentence and substitute the word <br />"acceptance". <br />3.4 ARTICLE 4 -ARCHITECT <br />A.4.2.2:Add the following:"The Contractor shall reimburse (in the form of reduced contract <br />amount)the Owner for compensation paid to the Engineer for additional site visits made <br />necessary by the fault,neglect,or request of the Contractor or by defects or deficiencies <br />in the work." <br />B.Add:"4.2.4.1 Instructions issued by the Engineer to the Contractor shall be adjudged an <br />interpretation of the Contract requirements and not an act of supervision.The Engineer <br />has no authority,nor accepts any responsibility,either directly or implied,to direct and <br />superintend the construction operations." <br />3.5 ARTICLE 5 -SUBCONTRACTORS <br />A.5.2.1:Delete the words,"as soon as practicable,"and substitute the words,"within seven <br />(7)days"in the first sentence and,add to the end of the paragraph,"An additional <br />purpose of this submission is to verify the list of subcontractors with the list submitted at <br />the bid opening." <br />B.5.4.3:In the second sentence,change "nevertheless remain"to read "not be". <br />3.6 ARTICLE 6 –CONSTRUCTION BY OWNER OR BY SEPARATE CONTRACTORS <br />A.No modifications. <br />3.7 ARTICLE 7 -CHANGES IN THE WORK <br />A.Add: <br />1."7.2.2 The allowance for overhead and profit combined,included in the total cost <br />to the Owner,shall be based on the following schedule: <br />Docusign Envelope ID: FA2D0569-6BCE-4E38-B3EE-9B3EFD09A753
