Ordinance #: <br />AN ORDINANCE AMENDING THE <br />ORANGE COUNTY ZONING ATLAS <br /> <br />WHEREAS, Orange County has received and processed a petition submitted by Orange County <br />(hereafter ‘the Applicant’) seeking to amend the Orange County Zoning Atlas, as established in <br />Section 1.2 of the Orange County Unified Development Ordinance (UDO), and <br /> <br />WHEREAS, this petition seeks to rezone +/- 69.58 acres (PIN: 9863-28-1858) from R-1 (Rural <br />Residential) to NR-CD (Non-Residential Conditional District) for the purpose of Schools: Preparatory; and <br /> <br />WHEREAS, the petition has been submitted with a site plan in accordance with the provisions of <br />Section 2.9.1 (C) of the UDO; and <br /> <br />WHEREAS, the requirements of Section 2.8 and 2.9 of the UDO have been deemed complete; and <br /> <br />WHEREAS, the Board has found the proposed zoning atlas amendment to be reasonably <br />necessary to promote the public health, safety, and general welfare; and <br /> <br />WHEREAS, the Board has found the proposed zoning atlas amendment to be consistent with the <br />adopted 2030 Comprehensive Plan and reasonable and in the public interest. <br /> <br />BE IT ORDAINED by the Board of Commissioners of Orange County that the Orange County Zoning <br />Atlas is hereby amended to rezone the aforementioned parcels to NR-CD (Non-Residential Conditional <br />District), as detailed within the submitted application. <br /> <br />BE IT FURTHER ORDAINED THAT in accordance with Section 2.9.1 (F) of the UDO the approval of <br />this Conditional Zoning application is subject to the following mutually agreed to conditions: <br /> <br />1. The property shall be developed consistent with the reviewed site plan and application as acted <br />upon by the Orange County Board of Commissioners on June 3, 2025. <br /> <br />2. The applicant will provide a single boundary survey of the high school property to replace the four <br />currently recorded. The road R.O.W. internal to the campus that runs perpendicular to New Grady <br />Brown School Road will be abandoned. The survey will be completed and recorded with a revised <br />deed no later than 18 months from zoning approval. <br /> <br />3. The applicant proposes a 30’-0” wide pedestrian easement along Orange Grove Road and a <br />portion of New Grady Brown School Road (to provide a pedestrian connection from this intersection <br />to the school). The site plan dated 2/12/2025 shows it behind the existing buffers; however, the final <br />location is to be determined and is contingent on the approval of the Orange County School Board. <br /> <br />4. The applicant proposes two future development areas as shown on site plan C2.0 dated 2/12/2025. <br />A. Area in northwest corner of existing site; and B. Area on the east side of existing site. Proposed <br />future development contained within these areas shall follow the Non-Residential Zoning <br />Compliance Permit process. <br /> <br />BE IT FURTHER ORDAINED THAT this ordinance be placed in the book of published ordinances and <br />that this ordinance is effective upon its adoption. <br /> <br />Upon motion of Commissioner _, seconded by Commissioner <br /> <br /> , the foregoing ordinance was adopted this __________ day of <br /> <br /> , 2025. <br />Attachment 7 95
