Approved Conditional Zoning District <br />Ordinance and Site Plan <br />Ashley Moncado, Planner III, 919-245-2589 <br />Cy Stober, Planning Director, 919-245-2592 <br />PURPOSE: To review and take action on a Major Subdivision Preliminary Plat application for the <br />property with Parcel Identification Numbers 9841-52-7281 and 9840-79-5091, located at 4801 and <br />4901 Dairyland Road, in accordance with the provisions of Section 2.15 and Article 7 of the Unified <br />Development Ordinance (UDO), as well as the binding land use conditions for this zoning district. <br />BACKGROUND: A Major Subdivision Preliminary Plat application was received proposing a 38-lot <br />subdivision with 40% open space. <br />Review Process: The proposed subdivision’s concept plan was previously reviewed and <br />approved by the Orange County Board of Commissioners as the site-specific plan of a <br />Residential Conditional District (R-CD) rezoning application on May 2, 2023. Both the site- <br />specific plan and the conditions of approval for this zoning district are available in Attachment <br />5. All agenda materials for this conditional zoning district can be viewed at the following link: <br />http://server3.co.orange.nc.us:8088/WebLink/0/doc/69878/Page1.aspx. <br /> A Major Subdivision application requires the submission of a preliminary plat and other <br />documents, in accordance with Section 2.15 of the UDO. <br />•First Action – Onsite visit with the Planning Director. <br />Staff Comment – The site visit was completed as part of the Conditional <br />Rezoning review process. <br />•Second Action – The applicant holds a Neighborhood Information Meeting (NIM). <br />Staff Comment: The NIM was completed as part of the Conditional Rezoning <br />process. NIM was held on March 22, 2023 at 5:15 p.m. at the Orange County <br />Public Library. The report from this meeting is in Attachment 3. <br />•Third Action - The Planning Board reviews and takes action on the Concept Plan <br />application approving Concept Plan - Flexible Development Plan. <br />210 <br />10
