The proposed use is consistent with existing non-residential development in the area
including storage of goods and warehouses. Standards contained in the UDO,
including landscaping and setbacks, will allow the use to be buffered from neighbors
and prevent negative impacts. The activity and impact of this use will be limited to the
property, generating low volumes of traffic and minimal lighting and noise. The site
will be developed with all applicable development standards from the Orange County
UDO to protect neighboring residential properties and minimize land use conflicts. In
addition, the termination of the existing go-kart use as a condition of approval will
address offsite impacts related to noise, lighting, pollution, and traffic.

 Land Use Goal 6: A land use planning process that is transparent, fair, open,
efficient, and responsive.

Staff Comment: The Orange County staff has noticed the public regarding this
application, as required by Sections 2.8.7, 2.9.1(D), and 2.9.2 of the UDO, including a
required Neighborhood Information Meeting, mailings to neighboring property
owners, posting of the property, and advertisement in the local newspapers.
Additionally, staff have provided all application documents on the Active Development
Projects webpage.

d. NC Highway 57 Small Area Plan Study
Staff Comment: The proposed Zoning Atlas Amendment is consistent with the goals of the
2030 Comprehensive Plan and the NC Highway 57 Small Area Plan study. The Small Area
Plan called for expanding economic development opportunities in the Little River Township
along NC Highway 57 and Mile Branch Road near the existing Orange County Speedway.
In addition, the rezoning request has met the Review Procedure standards of the Small
Area Plan.

e. The amendment is reasonable and in the public interest because it furthers the goals of
the adopted Comprehensive Plan and is located in an area designated on the Future Land
Use Map as “Agricultural Residential”.

The Planning Board hereby adopts this Statement of Consistency and the findings expressed
herein and recommends the Board of County Commissioners consider adoption of the
proposed Zoning Atlas Amendment.

Vote: ____ For, ____ Against
Lamar Proctor, Chair Date
207
