Customer <br /> will insure that its personnel are, at all times, educated and trained in the proper use and operation of <br /> products provided by Farragut and that products provided by Farragut are used in accordance with <br /> applicable manuals, instructions and specifications. <br /> CUSTOMER IS RESPONSIBLE FOR BACKING UP CUSTOMER'S DATA, SOFTWARE AND <br /> SYSTEMS. Customer will maintain back-up data, software and systems necessary to replace critical <br /> Customer data, software and systems in the event of loss, corruption or damage to data, software or <br /> systems from any cause. <br /> Customer represents and warrants to Farragut that it does not have any contracts or other obligations to <br /> third parties, including but not limited to any license agreements or confidentiality obligations, that will be <br /> violated in any respect by Customer's or Farragut's performance under this Agreement. <br /> Farragut Systems, Inc.
