4 <br />provision of mental health, developmental disability and substance <br />abuse services which shall be established, operated and governed by <br />the Parties pursuant to N.C.G,S. §122C-115.1; and <br />WHEREAS, Orange County, Person Colmty and Chatham County have <br />provided as a joint effort of the three counties, for the development, <br />review and approval of a business plan for the management and delivery <br />of mental health, developmental disability and substance abuse <br />services, with detailed information on how the county program will <br />meet State standards, laws and rules ensuring quality mental health, <br />development disability and substance abuse services, including outcome <br />measures for evaluating program effectiveness; and <br />WHEREAS, the Boards of Commissioners of Orange County, Person <br />County and Chatham County intend to form and by this Agreement do form <br />a three county public entity to serve as the local management entity <br />("LME") for the multi-county program created by Orange, Person and <br />Chatham counties; and <br />WHEREAS, the Parties have determined to engage in an tndertaking <br />whereby the three county public entity created by this Agreement to <br />serve as the local management entity may contractually exercise the <br />powers, functions, rights, privileges and immunities of the Parties <br />with regard to the provision of mental health, developmental <br />disability and substance abuse services in the Catchment Area; and <br />WHEREAS, this Interlocal Cooperation Agreement will allow the <br />three county public entity created by this Agreement to serve as the <br />local management entity to exercise the Undertaking; and <br />
