3 <br />INTERLOCAL COOPERATION AGREEMENT <br />FOR THE PROVISION OF MENTAL HEALTH, <br />DEVELOPMENTAL DISABILITY AND SUBSTANCE ABUSE SERVICES <br />BETWEEN ORANGE, PERSON AND CHATHAM COUNTIES <br />This Interlocal Cooperation Agreement made and entered into this <br />day of 2004, by, between and among Orange County, a <br />political subdivision of the State of North Carolina, Person County, a <br />political subdivision of the State of North Carolina and Chatham <br />County, a political subdivision of the State of North Carolina, herein <br />collectively referred to as the "Parties". This Agreement is made as <br />an Interlocal Cooperation Agreement pursuant to Chapter 122C of the <br />North Carolina General Statutes and Part I, Article 20 of Chapter 160A <br />of the North Carolina General Statutes. <br />W I T N E S S E T H: <br />WHEREAS, N.C.G.S. §122C-115(a) requires each county in North <br />Carolina to provide mental health, developmental disability and <br />substance abuse services either through an area authority or a county <br />program established pursuant to N.C.G.S. §122C-115.1; and <br />WHEREAS, N.C,G.S. §1220-115,1 authorizes counties to enter into <br />multi-county programs created through interlocal cooperation <br />agreements pursuant to N.C.G.S. §160A-460, et sec.; and <br />WHEREAS, Orange County, Person County and Chatham County together <br />comprise an area wherein the population is compliant with the targeted <br />minimum population of 200,000 as set forth in Chapter 1220 of the <br />North Carolina General Statutes; and <br />WHEREAS, Orange County, Person County and Chatham County have <br />each elected to operate together a multi-county program for the <br />
