328 <br /> Attachment A9 <br /> Ordinance#: ORD-2025-003 <br /> AN ORDINANCE AMENDING THE <br /> ORANGE COUNTY ZONING ATLAS <br /> WHEREAS, Orange County has received and processed an application seeking to amend the <br /> Orange County Zoning Atlas, as established in Section 1.2, of the Orange County Unified <br /> Development Ordinance (UDO); and <br /> WHEREAS, this petition seeks to rezone a 90.133 acre parcel of property (PIN 9739-72-0339), <br /> from AR (Agricultural Residential) to MPD-CD (Master Plan Development— Conditional District), <br /> for the purposes of developing a community center, small gathering venues, creative arts <br /> opportunities, and communal dining space. The development will consist of up to 150 modestly <br /> sized dwelling units, including individual homes, semi-attached homes, and multi-family buildings. <br /> Other amenities include a fitness center, accessible gardens, walking trails, and preserved green <br /> spaces; and <br /> WHEREAS, the requirements of Section 2.8 and 2.9 of the UDO have been deemed <br /> complete; and <br /> WHEREAS, the Board has found the proposed zoning atlas amendment to be reasonably <br /> necessary to promote the public health, safety, and general welfare; and <br /> WHEREAS, the Board has found the proposed zoning atlas amendment to be consistent with <br /> the adopted 2030 Comprehensive Plan and reasonable and in the public interest. <br /> WHEREAS, the property lies within the Haw River Unprotected Watershed delineated by the <br /> NC Department of Environmental Quality Water Supply Watershed program and is thereby <br /> consistent with that same zoning overlay district, as established in Section 4.2 of the UDO. <br /> BE IT ORDAINED by the Board of Commissioners of Orange County that the Orange County <br /> Zoning Atlas is hereby amended to rezone the aforementioned 90.133 acre parcel to MPD-CD <br /> (Master Plan Development— Conditional District), as detailed within the submitted application. <br /> BE IT FURTHER ORDAINED THAT in accordance with Section 2.9.1(F) of the UDO the <br /> approval of this Conditional Zoning application is subject to the following mutually agreed to <br /> conditions: <br /> 1. Project shall be completed as presented in approved site plan/application packet. <br /> 2. Allow for Planning Director to review and approve minor changes to the approved <br /> plan, per Section 2.9.1(1) of the Orange County Unified Development Ordinance, <br /> specific to the location and arrangement of development within the limits of <br /> disturbance and the proposed "activity area". The "activity area" shall be defined as <br /> the edge of gravel as shown on the provided conditional zoning plan set. <br /> 3. Allow for Planning Director to review and approve minor changes to the approved <br /> plan, per Section 2.9.1(1) of the Orange County Unified Development Ordinance. <br /> BE IT FURTHER ORDAINED THAT this ordinance be placed in the book of published <br /> ordinances and that this ordinance is effective upon its adoption. <br /> l <br />
