Resolution Authorizing the Sale and Alan Dorman, Asset Management <br /> Upset Bid Process for 0.26 Acre Services Director, 919-245-2627 <br /> Property, PIN #9862246076 <br /> PURPOSE: To approve the sale of a County-owned 0.26 acre property, PIN #9862246076, in <br /> Hillsborough, NC, and approve a resolution authorizing the sale of the property through a <br /> negotiated offer, advertisement, and upset bid process. <br /> BACKGROUND: The County owns a 0.26 acre property, PIN# 9862246076, located on New <br /> Hope Springs Drive off Davis Road south of Hillsborough. The property is comprised of a narrow <br /> slice of land of little value to the County (Attachment 1). The Orange County Tax Administration <br /> Office has valued the land between $4,000 and $8,400. Ravi and Rosemary Kumar, adjacent <br /> neighbors, approached the County with an offer to purchase for $4,500 (Attachment 2), and have <br /> submitted the proper documents and certified check for $225. <br /> When this property was originally created, the developer deeded the fee simple ownership to <br /> Orange County and PINs were assigned. This lot was never reserved or dedicated as a public or <br /> private right-of-way. It was common practice to create these lots as a "place holders" in the event <br /> that adjacent tracts were developed and connectivity was needed. <br /> In accordance with North Carolina General Statute 160A-269, public property may be sold through <br /> a negotiated offer, advertisement, and upset bid process. As all offers for the purchase of County <br /> property must be presented to the Board of County Commissioners for consideration, Attachment <br /> 3 is a resolution authorizing the sale of the property through an upset bid process. <br /> Should the Board approve the offer for the sale of this property in this manner; a notice of sale <br /> will immediately be placed in a local paper and on the County's Purchasing web page. The notice <br /> shall contain a general description of the property, the amount and terms of the offer, and a notice <br /> that within ten days any person may raise the bid by not less than ten percent (10%) of the first <br /> one thousand dollars, and five percent (5%) of the remainder. When a bid is raised, the bidder <br /> shall deposit with the County five percent (5%) of the increased bid, and the County shall re- <br /> advertise the offer at the increased bid amount for an additional ten (10) days.
