z <br />ORANGE COUNTY ZONING ORDINANCE TEXT AMENDMENTS (BOCC and Planning <br />Board Public Hearings) <br />Master Telecommunications Plan Map, This is an amendment to the Zoning <br />Ordinance, including but not limited to Article 6.18 and Article 8.8, and specifically <br />Article 6.18.5, entitled "Master Telecommunications Plan", and Article 8.8.17a, <br />entitled "Telecommunications Towers", to allow for the adoption of a "Master <br />Telecommunications Plan" Map ("MTP") that will identify sites within the County <br />where Telecommunications Tower facilities already exist and also pre-identified <br />properties ("Pre-identified Properties") whose owners have expressed an interest <br />in locating Telecommunications Towers in the future, subject to all Orange County <br />Zoning Ordinance requirements. Properties identified on the MTP may include <br />those related to fire stations, voluntary agricultural districts, public and private <br />utility authorities, State or County owned properties, privately owned properties, <br />etc. <br />As with any other proposed telecommunications tower facility, an application to <br />site a tower facility on Pre-identified Property on the MTP may be approved only <br />upon the issuance of a Special Use Permit and after meeting all other Orange <br />County Zoning Ordinance requirements. <br />Provided the initial MTP plan is adopted, the County will consider additions or <br />modifications to the MTP annually at the February Public Hearing each year. <br />Applications to add to, withdraw from or otherwise modify the MTP shall be filed <br />with the Zoning Officer prior to December 15th of each year. <br />Purpose: Tc identify properties within the County where telecommunications providers <br />are encouraged to research prior to submittal of an application to site a wireless <br />telecommunications facility. The MTP will help identify potential locations for collocated <br />telecommunications facilities including locations that serve or may be required to serve <br />the public safety telecommunications network. <br />2, Land Clearing Waste Facility (LCWF). This proposed zoning ordinance amendment <br />will create a new definition in the ordinance entitled 'Land Clearing Waste Facility to <br />allow the creaticn of an LCWF of less than 2 acres in size. An LCWF will be able to <br />accept only land clearing debris such as stumps, roots, topsoil, yard waste debris, limbs, <br />etc. An LCWF will not be allowed to accept inert debris such as bricks, asphalt, and <br />concrete products. The Table of Permitted Uses will be amended to allow a LCW F as a <br />permitted use by right in the AR, AS and RB zoning districts. Section 6 will be amended <br />to create a new secticn establishing the use conditions upon approval of a LCWF. <br />FINANCIAL IMPACT: There is no financial impact associated with this decision. <br />Advertisement costs are included in the budget for County initiated items, <br />RECOMMENDATION: The Administration recommends APPROVAL of the proposed <br />May 24, 2004 Quarterly Public Hearing legal advertisement. <br />
