Water and Sewer Service: The property is not located within a <br />primary utility service area meaning water and sewer service is <br />provided by an individual well and septic system. <br /> Surrounding Land Uses: a. NORTH: Undeveloped parcel, zoned AR; <br />b. SOUTH: Single-Family Dwelling, zoned AR; <br />c. EAST: Old Lake Trail, a private 60’ right-of-way; and <br />d. WEST: Lake Orange. <br /> <br />Proposal: As detailed within Attachment 1, the applicant has applied for a VARIANCE from the <br />required 150-foot reservoir buffer setback and 300-foot septic setback applied to the Lake <br />Orange reservoir (the 615-foot elevation contour line on the parcel) to allow for the construction <br />of a new residential structure to be located +/- 145 ft. from Lake Orange. This variance will <br />provide relief from the standard 150-foot reservoir buffer for new structures and 300-foot <br />setback for new nitrification fields. <br /> <br />Should a Variance be granted, all construction activity would be required to obtain proper <br />permitting through Orange County. <br /> <br />The Orange County UDO allows for “Existing Lots” to encroach upon established “stream <br />buffers” and “setbacks for septic systems”, but defines “existing lots” as those that were <br />“…created prior to January 1, 1994”. This lot was created through a recombination of two <br />adjacent lots on January 27, 2003, and is thereby ineligible for this administrative allowance by <br />staff. UDO 4.2.2(I). <br /> <br />ORDINANCE REQUIREMENTS: <br /> Per Section 6.13.4(c) Minimum Buffer Widths for Watershed Protection Overlay Districts <br />development project(s) within the Upper Eno Critical Area Overlay District are required to <br />adhere to the following buffer requirement(s): <br />a. 65-foot stream buffer, when slopes are less than 7.5%, applied to the outside of the <br />outside of the Special Flood Hazard Area (100 Year FloodZone) <br />b. 65-foot water body buffer, when slopes are less than 7.5%, applied to the outside of the <br />outside of the Special Flood Hazard Area (100 Year FloodZone) <br />c. 65-foot floodplain buffer, when slopes are less than 7.5%, applied to the outside of the <br />outside of the Special Flood Hazard Area (100 Year FloodZone) <br />d. 150-foot reservoir buffer applied to the outside of the Special Flood Hazard Area (100 <br />Year FloodZone) <br /> <br /> <br />17
