Thank you. 2 <br /> 3 <br />Leon Meyers: All right. 4 <br /> 5 <br />Taylor Perschau: Now it comes to you all for a time for any questions, deliberations, and finally a determination of 6 <br />findings of fact. As the applicant detailed, the planning director did determine that the application 7 <br />satisfies established submittal requirements, and there is sufficient documentation demonstrating 8 <br />general compliance with established development standards, as detailed in Section 5.6.8 of the 9 <br />UDO. Staff doesn't make a formal recommendation on the approval of the application or on the 10 <br />compliance of the project with the general standards in Section 5.3.2.(A).(2), so you all must 11 <br />determine if the use will maintain or promote the public health, safety, and general welfare if located 12 <br />where proposed and developed and operated according to the plan as submitted; if these will 13 <br />maintain or enhance the value of contiguous property, unless the use is a public necessity, in which 14 <br />case the use may not maintain or enhance the value of contiguous property; and finally, you must 15 <br />determine if the location and character of the use, if developed according to the plan submitted, will 16 <br />be in harmony with the area in which it is to be located, and the use is in compliance with the plan 17 <br />for the physical development of the county as embodied in these regulations or in the comprehensive 18 <br />plan, or a portion thereof adopted by the Board of County Commissioners. I'm going to defer to you, 19 <br />Chair Meyers, if you want more detail from me or if you want to go ahead and kind of start making 20 <br />your deliberations. 21 <br /> 22 <br />Leon Meyers: Board members, would some additional information from Taylor be helpful, or should we bring the 23 <br />application before the board and discuss? Questions for Taylor? Sounds like we're well informed. 24 <br />That's a dangerous statement. Good, well, the application then is before the board. There are some 25 <br />conditions that are listed in the application on Page 34 and in Exhibit E on Page 44, and Mr. Hornik, 26 <br />I assume there's no change in those conditions that have been a part of the application. 27 <br /> 28 <br />Kevin Hornik: That's correct to the best of my knowledge. I'll ask Mr. Tilson to confirm that. 29 <br /> 30 <br />James Tilson: Correct. 31 <br /> 32 <br />Leon Meyers: Okay. Then the findings I think, would be the first decision for the board. Is that right, legal 33 <br />department? Right? The findings are on Page 111 of the package. And unless there is anything 34 <br />that the board needs to discuss, a motion would be in order to approve the findings listed on, I'm 35 <br />sorry, tagged Page 109 in the package. 36 <br /> 37 <br />Nathan Robinson: I make a motion to approve finding of facts on Page 111. 38 <br /> 39 <br />Leon Meyers: Motioned.
