FINDINGS OF FACT <br />BY THE ORANGE COUNTY BOARD OF ADJUSTMENT <br />PERTAINING TO A REQUEST SUBMITTED BY <br />TRIANGLE LAND CONSERVANCY <br />PROPOSING A “CAMP” USE <br />ON A PARCEL OF PROPERTY LOCATED AT 3223-UT NEW HOPE CHURCH ROAD <br />(PIN 9883-30-4125) <br />Based upon the competent, material, and substantial evidence received at the evidentiary <br />hearing, the Board of Adjustments gave each piece of evidence its due weight and makes the <br />following Findings of Fact: <br />Application Components <br />1.Triangle Land Conservancy filed an application for a Special Use Permit (SUP) related to <br />Orange County PIN 9883-30-4125 on April 12, 2024 for Use 32, Camp with a fee paid. <br />2.The application included site plans and attachments as included in the agenda materials <br />received by the BOA, specifically: Attachment 1. <br />3.The existing conditions on the property include: The property exists as Brumley Forest <br />Nature Preserve, a privately owned and publicly accessible preserve. <br />4.The proposed structures include: two 16’ x 25’ and one 16’ x 20’ carport structures. <br />5.The access, parking, and “Camp” areas include: The project will be utilizing the existing <br />paved road for access and parking needs. The Camp use area is currently defined as +/- <br />12.01 acres; the Special Use Permit is to be applied to the entirety of the subject parcel. <br />6.The landscaping includes: existing vegetation is to be maintained in order to meet the <br />minimum 30 foot Type B buffer required around the parcel perimeter per UDO Section <br />5.7.5 for the Camp use . <br />7.Taylor Perschau, a member of the Orange County Planning & Inspections Department <br />staff, provided sworn testimony regarding receipt of the following: complete site plan, a list <br />of parcels within 1,000 feet, complete Environmental Assessment, method of debris <br />disposal, and development schedule. <br />Notice Requirements <br />8.Notices of a Neighborhood Information Meeting were mailed on May 8, 2024 by the <br />applicant and the meeting was held on May 23, 2024. <br />9.Notices of the BOA Evidentiary Hearing were mailed on November 26, 2024 and the <br />meeting held on December 11, 2024. <br />10.Signs were posted on May 10, 2024 for the Neighborhood Information Meeting and on <br />November 26, 2024 for the Evidentiary Hearing. <br />Waste, Safety & Access <br />11.The waste disposal methods were reviewed by Orange County Environmental Health <br />Department, and Orange County Solid Waste Department. Neither reviewing agency <br />indicated concerns for the method of waste disposal proposed. <br />12.The method of police, fire and rescue squad protection were reviewed by Orange County <br />Emergency Services Fire and Life Safety Division. There was no indication of concern. <br />13.The method of vehicle access was reviewed by NCDOT District 1. There was no indication <br />of concern. <br />Camp <br />14.Site plan submitted: Site plan was provided in compliance with Section 2.5 of the UDO. <br />15.No phasing plan is being requested. <br />16.Adequate sewage disposal to be determined by lot size and soil suitability: the Camp <br />use utilizes a portable toilet at present and offers no plan for on-site wastewater <br />Attachment 6B 119
