6 <br />Ordinance Requirements <br />“Kennel (Class II)” is defined as Use #62(M) in the Table of Permitted Uses and within Article 10 Definitions <br />of the UDO as: <br />“An establishment involving animals of any species, excluding domesticated livestock, engaged in any <br />of the following: <br />a)The owning or keeping, for any purpose, of 20 or more animals; <br />b)The selling and/or training of guard dogs or security dogs; <br />c)The keeping of more than five animals at any given time for the purpose of breeding, <br />boarding, or rehabilitation. <br />The operator of a Kennel (Class II) shall be allowed to reside on the property to ensure the continuous <br />care of the animals kept on-site.” <br />In the case of this application, a Special Use Permit is required because the proposed use <br />would keep more than five animals at any given time. The Dog Den is designed to board up to <br />eight animals for overnight boarding. <br />Section 5.2.1 Table of Permitted Uses of the UDO lists “Kennel (Class II)” as a permitted use of property <br />within the AR general use zoning district subject to the issuance of a SUP. <br />Standards governing the development of a “Kennel (Class II),” as detailed in Section 5.6.8 of the UDO, are <br />as follows: <br />(1)Submittal Requirements. In addition to the information required by Section 2.7 or 2.9, as <br />applicable, the following information shall be supplied as part of the application for approval of this <br />use: <br />(a)Plans for all kennels, exercise yards, dog runs, pens and related improvements, <br />including signage. <br />(b)Site plan showing the improvements listed in a) above, other structures on the same lot, <br />and structures on adjacent property. <br />STAFF COMMENT: A Site Plan has been submitted with this request providing required <br />details. <br />Please note, this is the required site plan denoting compliance with the UDO as it relates to <br />the issuance of the SUP. A final site plan and Zoning Compliance Permit shall be required for <br />review and approval by the County prior to the commencement of earth disturbing activities <br />as required in Section 2.5: Site Plan Review of the UDO. Should the SUP be approved, the <br />Planning Director may only approve minor modifications from the site plan provided with this <br />application, as specified by Orange County UDO Section 2.7.14. <br />The applicant has also included a detailed narrative providing additional information on the <br />nature of the operations and activities envisioned for the property. <br />(2)Standards of Evaluation <br />(a)The site is of adequate size to protect adjacent properties from adverse effects of the <br />kennel. <br />STAFF COMMENT: Details provided within the Application Package (Attachment 1). The <br />UDO does not define what “adequate size” means in this instance. The subject parcel is +/- <br />32.4 acres and all “Kennel (Class II)” features are sited well within the required 150-foot <br />80
