No part of any building, structure, dog run, pen, or exercise yard in which animals <br />are housed or exercised shall be closer than 150 feet from a property line: the <br />Kennels (Class II) use meets the required 150-foot setback from all property lines. <br />(UDO Section 5.6.8(B)(2)(b), Finding of Fact 2 and 17); and, <br />d. Any kennel, including primary enclosures or runs, which is not wholly enclosed <br />within a building shall be enclosed by a security fence at least six feet in height <br />(UDO Section 5.6.8(B)(2)(c), Finding of Fact 2 and 18); and, <br />e. The site plan shows parking, access areas, and screening devices for all buildings <br />and animal boarding facilities existing or proposed for the property, (UDO Section <br />5.6.8(B)(2)(d), Finding of Fact 2 and 19); and, <br />f. The site plan shall be reviewed by the Orange County Animal Services Department <br />and found in conformance with the Animal Control Ordinance, (UDO Section <br />5.6.8(B)(2)(e), Finding of Fact 2 and 20); and, <br />g. Building plans for all kennel facilities shall be reviewed and approved by the <br />Orange County Animal Services Department prior to issuance of any building <br />permits, (UDO Section 5.6.8(B)(2)(f), Finding of Fact 2 and 21); and, <br />h. All proposed signage shall comply with dimensional requirements as set forth <br />within Section 6.12, (UDO Section 5.6.8(B)(2)(g), Finding of Fact 2 and 22); <br />i. All necessary permits shall be obtained from Orange County Animal Services <br />within the first 30 days of occupancy. Failure to obtain and maintain a valid Class <br />II Kennel Permit or other related permits which may be required by the USDA or <br />Wildlife Resources Commission will result in revocation of the Special Use Permit, <br />(UDO Section 5.6.8(B)(2)(h), Finding of Fact 2 and 23). <br />5. General welfare, value and harmony standards applicable to all SUPs have been met, <br />including: <br />a. The use will maintain or promote the public health, safety and general welfare, if <br />located where proposed and developed and operated according to the plan as <br />submitted (UDO 5.3.2(A)(2)(a), Finding of Fact 28); and, <br />b. The use will maintain or enhance the value of contiguous property (UDO <br />5.3.2(A)(2)(b), Finding of Fact 25); and, <br />c. The location and character of the use, if developed according to the plan <br />submitted, will be in harmony with the area in which it is to be located and the use <br />is in compliance with the plan for the physical development of the County as <br />embodied in these regulations or in the Comprehensive Plan, or portion thereof, <br />adopted by the Board of County Commissioners (UDO 5.3.2(A)(2)(c), Finding of <br />Fact 26).
