The method of police, fire and rescue squad protection were reviewed by Christopher <br />Pendergrass, Interim Fire and Life Safety Division Chief and County Fire Marshal. There <br />was no indication of concern. <br />13. The method of vehicle access was reviewed by David Genwright, Assistant District <br />Engineer with NCDOT District Office. There was no indication of concern. <br /> <br />Kennel (Class II) <br />14. Site plan submitted: Site plan was provided in compliance with Section 2.5 of the UDO. <br />15. The lot size is: +/- 32.4 acres, all of which are subject to the SUP for Use #62(M), Kennel <br />(Class II). <br />16. The site is of an adequate size to protect adjacent properties from adverse effects of the <br />kennel: There is no lot size minimum for a “Kennel (Class II)” use. The subject parcel is <br />heavily wooded, and the use maintains the minimum 150-foot setback from all property <br />lines. <br />17. No part of any building, structure, dog run, pen, or exercise yard in which animals are <br />housed or exercised shall be closer than 150 feet from a property line: the “Kennel (Class <br />II)” use meets the required 150-foot setback from all property lines. The closest “Kennel <br />(Class II)” element is 215 feet from the eastern property line. <br />18. Any kennel, including primary enclosures or runs, which is not wholly enclosed within a <br />building shall be enclosed by a security fence at least six feet in height: the proposed <br />30,000 square foot fenced area is detailed to be enclosed by a fence six feet in height. <br />19. The site plan shows parking, access areas, and screening devices for all buildings and <br />animal boarding facilities existing or proposed for the property: required minimum parking <br />is featured by the Dog Den and all “Kennel (Class II)” facilities are screened by the existing <br />natural vegetation on-site while also meeting the 150’ setback from property lines. <br />20. The site plan shall be reviewed by the Orange County Animal Services Department and <br />found in conformance with the Animal Control Ordinance: the application package was <br />sent to Animal Services on September 27, 2024 for review. Orange County Animal <br />Services completed review and indicated no concerns with the proposed project. <br />21. Building plans for all kennel facilities shall be reviewed and approved by the Orange <br />County Animal Services Department prior to issuance of any building permits: the <br />applicant is aware of this requirement as was detailed in the Development Advisory <br />Committee comments dated September 19, 2024. <br />22. All proposed signage shall comply with dimensional requirements as set forth within <br />Section 6.12: the applicant is not proposing any signage for the “Kennel (Class II)” use. <br />23. All necessary permits shall be obtained from Orange County Animal Services within the <br />first 30 days of occupancy. Failure to obtain and maintain a valid Class II Kennel Permit <br />or other related permits which may be required by the USDA or Wildlife Resources <br />Commission will result in revocation of the Special Use Permit: the applicant is aware of <br />this requirement as was detailed in the Development Advisory Committee comments <br />dated September 19, 2024. <br />24. The applicant requested an additional 6 month vesting period. <br /> <br />General Welfare, Value & Harmony <br />25. The expected value difference with the proposed use for contiguous property is: As <br />presented and entered as evidence on the evening of the evidentiary hearing. <br />26. The location and character of the use is: If developed according to the plan submitted and <br />in accordance with the conditions, the project will be in general harmony with the <br />surrounding area and the use would be in compliance with the plan for the physical
