<br />applicable edition of FTA Circular 4703.1, “Environmental Justice Policy Guidance for Federal
<br />Transit Administration Recipients,”, August 15, 2012, to the extent consistent with applicable
<br />Federal laws, regulations, and guidance.
<br />13.Additional Environmental Requirements (requirements for environmental studies)
<br />The Contractor agrees to comply with the following:
<br />Corridor Preservation. That development of right-of way acquired under 49 U.S.C. §
<br />5323(q), as amended by MAP-21, will not occur in anticipation of its Project until all
<br />required environmental reviews for that Project have been completed;
<br />Use of Certain Public Lands. assures that it will comply specifically 49 U.S.C. § 303,
<br />which requires certain findings be made before an FTA-funded Project may be carried
<br />out that involves the use of any publicly owned land.
<br />Wild and Scenic Rivers. It will comply, with Federal protections for the national wild and
<br />scenic rivers system, 16 U.S.C. §§ 1271 – 1287,
<br /> Coastal Zone Management. assure Project consistency with the approved State
<br />management program developed under the Coastal Zone Management Act of 1972, as
<br />amended, 16 U.S.C. §§ 1451 – 1465,
<br />Wetlands. agrees to, and assures that it will, facilitate compliance with the
<br />protections for wetlands provided in Executive Order 119 No. 11990, as
<br />amended, “Protection of Wetlands,” 42 U.S.C. § 4321 note,
<br />Floodplains. agrees to, and assures that it will, facilitate compliance with the flood
<br />hazards protections in floodplains provided in Executive Order No. 11988, as amended,
<br />“Floodplain Management,” 42 U.S.C. § 4321 note,
<br />Endangered Species and Fishery Conservation agrees to comply, and
<br />assures that it will comply, with the protections for endangered species of
<br />The Endangered Species Act of 1973, as amended, 16 U.S.C. §§ 1531 –
<br />1544,
<br />Hazardous Waste. assures that it will, facilitate compliance with the
<br />Comprehensive Environmental Response, Compensation, and Liability Act,
<br />as amended, 42 U.S.C. §§ 9601 – 9675, which establishes requirements for
<br />the treatment of areas affected by hazardous waste
<br />Historic Preservation. agrees to, and assures that it will:
<br />o Comply with U.S. DOT laws, including 49 U.S.C. § 303, which
<br />requires certain findings be made before a Project involving the use
<br />of any land from a historic site that is on or eligible for inclusion on
<br />the National Register of Historic Places may be undertaken
<br />o Encourage compliance with the Federal historic and archaeological
<br />preservation requirements of section 106 of the National Historic
<br />Preservation Act, as amended, 16 U.S.C. § 470f,
<br />o Facilitate compliance with Executive Order No. 11593, “Protection
<br />and Enhancement of the Cultural Environment,” 16 U.S.C. § 470
<br />note,
<br />o Comply with the Archaeological and Historic Preservation Act of
<br />1974, as amended, 16 U.S.C. § 469a – 469c,
<br />o Comply with U.S. Advisory Council on Historic Preservation
<br />regulations, “Protection of Historic Properties,” 36 C.F.R. part 800,
<br />which requires the Recipient to:
<br />o Consult with the State Historic Preservation Officer concerning
<br />investigations to identify properties and resources included in or
