50
• Expands Section 2.3 "Specific Services and Responsibilities" to incorporate more direct
and measurable impacts on Orange County residents and businesses. This includes
points such as:
o Discounted usage fees for Orange County residents who use the services of
PFPC.
o Annual PFPC Open House and Report for the public with invitation to Orange
County elected leaders.
o A minimum of two workshops annually for farmers to help them better understand
how to access and use PFPC as a resource for value-added products.
o Increased outreach efforts to appropriate programs that can benefit from
interaction with PFPC resources and staff.
• Ensures PFPC complies with the Orange County Living Wage Policy, Smoke Free Public
Places Rule, and the Orange County Non-Discrimination Policy.
• Clarifies what capital equipment is owned by the County and what is owned by PFPC to
provide clarity on who is responsible for maintaining certain equipment.
• Updates and clarifies indemnification and insurance sections.
• Adds section on hazardous substances and what is not allowed in the facility.
• Adds section on States of Emergency to indicate that the agreement may be suspended
if necessary during such situations to address the cause or effects of the emergency.
Jonathon Smith, Cooperative Extension Director, reviewed the background information for
the item.
Chair Bedford thanked him for the work on this agreement.
Commissioner Fowler asked about the discount for usage fees.
Eric Hallman, PFPC Executive Director, said there are a couple of different ways to
administer the discounts. He said that it can be across the board for all Orange County residents
or there could be a discount for those Orange County residents just starting their business.
Commissioner Fowler asked how fees compare to other processing facilities in the state.
She asked if fees could be increased for non-Orange County residents.
Eric Hallman said fees are right at the median.
Commissioner Hamilton said she can see the work put into this agreement and it makes
things clearer. She asked about 7.1.c and for information on who the indemnitee and indemnitors
referred to.
John Roberts said either party can be the indemnitee or the indemnitor, but this covers if
a third party comes into play.
Commissioner Fowler said she feels there should be a discrepancy between what people
in Orange County pay versus out of county users. She asked if those out of county users could
have fees raised.
Eric Hallman said he wanted to present the two scenarios to see where they need to go.
He said that if they want to give across the board discounts to all Orange County residents, the
impacts would be less. He said that if you keep subsidizing a business, they do not get a full idea
of what the cost of doing business is.
Commissioner Fowler said she gets that and maybe if they are doing well, they could be
moved out. She asked if out of county folks get charged more.
Eric Hallman said they do not think that would be necessary.
Commissioner Fowler asked if they do that with the SportsPlex.
Travis Myren said that covers only school district employees or county employees.
Vice-Chair Greene said she likes the idea that the people just starting out need the extra
incentive.
