.380 <br />A BILL TO BE ENTITLED AN ACT TO PROVIDE FOR THE RE-EVALUATION OF REAL PROPERTY TAKE! FOR PUBLIC <br />When any telegraph, telephone, electric power, lighting or pipeline company, or the North <br />Carolina State Highway Commission, acquires an easement over real property either by contract or <br />condemnation, it shall be the duty of the county and of any municipality or other local ad valorem <br />taxing authority or political subdivision within which the concerned lands may lie to re-evalue <br />said lands. Said re-evaluation shall be accomplished not later than the year following the taking <br />of aiW right of way or other rights under the power of eminent domain. <br />Members of the County Board. of Education met jointly with the Orange County Board of <br />Commissioners. The purpose of this joint meeting was to appoint a member for the County A. B. C. <br />Board. <br />Upon motion of Commissioner Cleveland, R. J. Smith, Sr., was unanimously re-appointed to <br />the County A. B. C. Board for a term of three(3) years, said term to commence at the expiration <br />of his present term. <br />There being no other business, the joint meeting of the County Board of Education and the <br />County Board of Commissioners adjourned. <br />Sherman Shelton, Agricultural Extension Agent, and Mrs. Bonnie Davis, Home Economics Extension <br />Agent, presented their Annual Narrative Report for 1961 to the Board. <br />Commissioner Cleveland brought to the attention of the Board the fact that under G.S. <br />certain hospital insurance companies are now exempt from property tax. It was his feeling that <br />this statute should be repealed. <br />Upon motion of Commissioner Cleveland, seconded by Commissioner Walker, and unanimously <br />adopted, the legislative delegates from Orange County were to be advised of G.S. l/ and <br />requested to introduce legislation repealing said statute. <br />The Commissioners requested the County -Administrator to compile a list of tax exempt insti- <br />tutions which are now located in Orange County. This list is to be made up of those institutions <br />which he feels should not come under the tax exempt statute. <br />By agreement of the Board, the following proposed legislation entitled "A Bill to be Entitled <br />an Act to Ament the Laws of Eminent Domain in North Carolina", which was presented by G. P. Sykes, <br />was unanimously adopted: <br />A BILL TO BE ENTITLED AN ACT TO AMEND THE LA;;'S OF EMINENT DOMAIN IN NORTH CAROLINA <br />When any telegraph, telephone, electric power, lighting or pipeline company acquires an <br />easement either by contract or condemnation, it shall be the duty of such company in regards to <br />said easement: <br />(a) When any timber or brush shall be cut or cleared on the right-of-way or adjoining land, <br />said company shall remove or destroy all slash, stumps and other refuse. <br />(b) Except where the owners of the property has planted agricultural crops on such easement, <br />it shall be the duty of the company to plant any cleared portion of such easement in a manner and <br />with a type of planting which will conserve the soil, prevent wail erosion, be beneficial to wild- <br />life and shall be approved by the North Carolina Commissioner of Agriculture. <br />(c) Prior to the cutting of any timber on land adjacent to the right-of-way of said company, <br />the company shall notify the landowner concerned that said timber is to be out, and such landowner <br />shall be afforded the choice of retaining his timber so cut or of requiring such company to remove <br />the out timber from his premises. Notice under this paragraph shall be sufficient if posted by <br />regular Tinted States mail at least five days and not more than thirty days prior to the cutting <br />of timber. If no response has been made to such notice when timber is cut, it shall be removed by <br />the company. <br />The violation of any of the provisions of this section shall constitute a misdemeanor <br />punishable in the discretion of the court. <br />Upon motion of Commissioner Walker the Clerk was directed to write the State Highway Commis- <br />sion and request that the local load limit on County Road #1114 leading from N. C. highway 70 to <br />Interstate 85 and locally known as the Buckhorn Road be removed. This motion was unanimously adopted. <br />Chairman Bennett yielded the chair to Vice Chairman :-Talker for the purpose of tendering his <br />resignation as a member of the County Welfare Board. Said resignation was accepted with regret. <br />Upon motion of Commissioner Cleveland, seconded by Commissioner Walker, and unanimously <br />adopted Commissioner Ray was appointed to fill the unexpired term of Commissioner Bennett on the <br />County Welfare Board. <br />There being no further business to come be ore the Board said meeting was adjourned. <br />S.
