OTHER INSURANCE CONDITION FOR ADDITIONAL INSUREDS — <br />NON-CONTRIBUTORY -BLANKET BASIS <br />COMMERCIAL UMBRELLA LIABILITY <br />CXL 449 06 17 <br />THIS ENDORSEMENT CHANGES THE POLICY. PLEASE READ IT CAREFULLY. <br />This endorsement modifies insurance provided under the following: <br />COMMERCIAL UMBRELLA LIABILITY COVERAGE PART <br />The following is added to SECTION IV —CONDITIONS,Paragraph H. Other Insurance: <br />With respect to each additional insured under SECTION II, WHO IS AN INSURED, Paragraph A.5.,this insurance is <br />(i) excess over any “underlying policy”, and (ii) primary to, and we will not seek contribution from,any other insurance <br />providing coverage to any such additional insured whether primary or excess. However, we will not waive our right to <br />seek contribution from other insurance unless: <br />a.The additional insured is a Named Insured under such other insurance; <br />b.The additional insured is included as an additional insured on an “underlying policy”; <br />c.You have agreed in a written contract, written agreement or written permit that this insurance would be <br />primary to and/or would not seek contribution from any other insurance provided to the additional insured; and <br />d.The written contract or written agreement has been executed (executed means signed by the Named Insured) <br />or written permit issued prior to the “bodily injury”or “property damage”or “personal and advertising injury”. <br />The most we will pay on behalf of the additional insured is the amount of insurance required by the written contract, <br />written agreement or written permit, less any amounts payable by any “underlying insurance”, subject to SECTION III <br />— LIMITS OF INSURANCE. <br />This provision is included within and does not act to increase the Limits of Insurance stated in the Declarations. <br />Copyright, 2016 Selective Insurance Company of America.
