Concrete, Inc. is an independent contractor and further agrees to pursue remedies only against Chasen
<br />Concrete, Inc. for work performed by Chasen Concrete, Inc.

<br />Cracks: Concrete, like many materials, contracts and expands due to the elements. When this
<br />occurs, cracks occur from time to time. Cracks can occur as early as the same day Chasen Concrete,
<br />Inc. will install your concrete with quality craftsmanship and proper contraction joints. Chasen
<br />Concrete, Inc., however, cannot guarantee against any cracks .
<br />
<br />Color variances: Concrete color variances occur due to the manufacturing process of multiple
<br />batches, plant locations, ingredients of the concrete, weather, type of subgrade, direction of broom
<br />strokes and other factors. While Chasen Concrete, Inc. will make every effort to produce the
<br />requested color, it cannot guarantee against color outcome in the concrete..
<br />
<br />Surface Traction: The traction of a concrete surface depends on the type of concrete chosen (e.g.
<br />stamped vs. broom-finished, etc.), and other factors such as weather, concrete ingredients, and the
<br />manufacturing process of multiple batches. Chasen Concrete, Inc. will install your concrete with quality
<br />craftsmanship. Chasen Concrete, Inc., however, cannot guarantee a particular level of traction or
<br />consistency of broom strokes.
<br />
<br />Formwork/Backfill: Often, the installation of concrete requires grading. Frequently, Chasen Concrete,
<br />Inc. has to dig or elevate sufficient area for the forms to fit the correct elevation in order to ensure proper
<br />water drainage. When excavating the area and after the forms are removed, there will be a gap between the
<br />new concrete and the existing grade. Unless Chasen Concrete, Inc. is hired to perform this work, the
<br />customer will be responsible for backfilling this area. If your concrete project needs to be elevated, fill
<br />material will need to be used. We encourage some type of backfill (e.g. dirt, mulch, etc.) to be used to the
<br />top of the concrete or a retaining wall material. The purpose is to keep material under the slab, and for it to
<br />not wash or settle outward. Unless Chasen Concrete, Inc. is hired to perform this work, the customer will
<br />be responsible for backfilling this area.
<br />
<br />Purchase Price: If the customer fails to pay the full amount of the agreed upon price, inclusive of
<br />authorized additions, all warranties, including implied warranties, will not be honored by Chasen Concrete,
<br />Inc. until the full amount of the Purchase Price, inclusive of authorized additions, is paid to Chasen
<br />Concrete, Inc.
<br />
<br />Litigation Costs: If any legal action, arbitration, or other proceeding is brought for the enforcement of this
<br />Agreement, or because of an alleged dispute, breach, default or misrepresentation in connection with any of
<br />the provisions of the agreement, the successful or prevailing party or parties shall be entitled to recover
<br />reasonable attorney’s fees and other costs incurred in the action or proceeding, in addition to any other
<br />relief to which it or they may be entitled.
<br />
<br />Entire Agreement: This Agreement constitutes the entire Agreement between the parties, pertaining to
<br />the subject matter contained in it, and supersedes all prior and contemporaneous agreements,
<br />representations and understandings of the parties. No supplement, modification or amendment to this
<br />Agreement shall be binding, unless all parties execute it in writing.
<br />
<br />Waiver: No waiver of any of the provisions of this Agreement shall be deemed or shall constitute a waiver
<br />of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No
<br />waiver shall be binding unless executed in writing by the party making the waiver. Signature of one or
<br />both parties constitutes a legal and binding sales/service contract. When customer signs, he signifies he
<br />understands all terms and clauses.

<br />Headings; Captions: The captions and section headings are inserted only as a matter of convenience and
<br />reference and in no way define, limit or describe the scope of this contract or the intent of any of its
<br />provisions.
