Letter from Town of Chapel Hill <br /> PURPOSE: To make a recommendation to the North Carolina Department of Transportation <br /> (NCDOT) and the North Carolina Board of Transportation (NC BOT) concerning a petition to add <br /> Shagbark Court and Mocker Nut Lane in the South Grove Subdivision to the State-Maintained <br /> Secondary Road System. <br /> BACKGROUND: This request includes a petition for two (2) road additions to the State <br /> Maintained Secondary Road System. The road lengths and widths are as follows: <br /> Road Name Length in Number of Frontage Pavement and Right-of-Way <br /> Miles Lots with Houses Widths in Feet <br /> Shagbark Court 0.23 19 22-ft pavement, 50-ft Right-of-Way <br /> Mocker Nut Lane 0.07 6 22-ft pavement, 50-ft Right-of Way <br /> Total 0.30 25 <br /> The South Grove Subdivision is located in Orange County along US 15 501 S, northeast of Smith <br /> Level Road (State Road 1919) (Attachments 1 and 2). This single-family residential subdivision <br /> is within Chapel Hill's Extra-Territorial Jurisdiction (ETJ). However, per North Carolina General <br /> Statutes §136-62, the Board of County Commissioners (BOCC) is an appropriate governing body <br /> to approve the road addition request associated with the subdivision. There are no known <br /> violations associated with the subdivision, as confirmed by the Town of Chapel Hill (Attachment <br /> 5). <br /> The South Grove Subdivision was recorded on January 7, 2013 (Book 110/Page 178) <br /> (Attachment 3). Shagbark Court and Mocker Nut Lane were designed to public road standards, <br /> but have been private roads in the interim. The roads were intended to become public roads <br /> when conditions met NCDOT maintenance responsibility and ownership criteria, as reflected on <br /> the recorded plat. Shagbark Court serves as the entrance to the subdivision off of US 15-501 <br /> South and terminates in a cul-de-sac on the east end of the subdivision. Mocker Nut Lane <br /> intersects with Shagbark Court and terminates at the northern property line in a road stub. <br />
