50 <br /> 1 Expands Section 2.3 "Specific Services and Responsibilities" to incorporate more direct <br /> 2 and measurable impacts on Orange County residents and businesses. This includes <br /> 3 points such as: <br /> 4 o Discounted usage fees for Orange County residents who use the services of <br /> 5 PFPC. <br /> 6 o Annual PFPC Open House and Report for the public with invitation to Orange <br /> 7 County elected leaders. <br /> 8 o A minimum of two workshops annually for farmers to help them better understand <br /> 9 how to access and use PFPC as a resource for value-added products. <br /> 10 o Increased outreach efforts to appropriate programs that can benefit from <br /> 11 interaction with PFPC resources and staff. <br /> 12 Ensures PFPC complies with the Orange County Living Wage Policy, Smoke Free Public <br /> 13 Places Rule, and the Orange County Non-Discrimination Policy. <br /> 14 Clarifies what capital equipment is owned by the County and what is owned by PFPC to <br /> 15 provide clarity on who is responsible for maintaining certain equipment. <br /> 16 Updates and clarifies indemnification and insurance sections. <br /> 17 • Adds section on hazardous substances and what is not allowed in the facility. <br /> 18 • Adds section on States of Emergency to indicate that the agreement may be suspended <br /> 19 if necessary during such situations to address the cause or effects of the emergency. <br /> 20 <br /> 21 Jonathon Smith, Cooperative Extension Director, reviewed the background information for <br /> 22 the item. <br /> 23 Chair Bedford thanked him for the work on this agreement. <br /> 24 Commissioner Fowler asked about the discount for usage fees. <br /> 25 Eric Hallman, PFPC Executive Director, said there are a couple of different ways to <br /> 26 administer the discounts. He said that it can be across the board for all Orange County residents <br /> 27 or there could be a discount for those Orange County residents just starting their business. <br /> 28 Commissioner Fowler asked how fees compare to other processing facilities in the state. <br /> 29 She asked if fees could be increased for non-Orange County residents. <br /> 30 Eric Hallman said fees are right at the median. <br /> 31 Commissioner Hamilton said she can see the work put into this agreement and it makes <br /> 32 things clearer. She asked about 7.1.c and for information on who the indemnitee and indemnitors <br /> 33 referred to. <br /> 34 John Roberts said either party can be the indemnitee or the indemnitor, but this covers if <br /> 35 a third party comes into play. <br /> 36 Commissioner Fowler said she feels there should be a discrepancy between what people <br /> 37 in Orange County pay versus out of county users. She asked if those out of county users could <br /> 38 have fees raised. <br /> 39 Eric Hallman said he wanted to present the two scenarios to see where they need to go. <br /> 40 He said that if they want to give across the board discounts to all Orange County residents, the <br /> 41 impacts would be less. He said that if you keep subsidizing a business, they do not get a full idea <br /> 42 of what the cost of doing business is. <br /> 43 Commissioner Fowler said she gets that and maybe if they are doing well, they could be <br /> 44 moved out. She asked if out of county folks get charged more. <br /> 45 Eric Hallman said they do not think that would be necessary. <br /> 46 Commissioner Fowler asked if they do that with the SportsPlex. <br /> 47 Travis Myren said that covers only school district employees or county employees. <br /> 48 Vice-Chair Greene said she likes the idea that the people just starting out need the extra <br /> 49 incentive. <br />
