1
ORANGE COUNTY
BOARD OF COMMISSIONERS
ACTION AGENDA ITEM ABSTRACT
Meeting Date: September 17, 2024
Action Agenda
Item No. 8-b
SUBJECT: Proposed Sale of 0.2 Acre Property, PIN #9863668236, in Hillsborough
DEPARTMENT: Asset Management Services
ATTACHMENT(S): INFORMATION CONTACT:
1. Offer to Purchase Alan Dorman, Asset Management
2. Location Map Services Director, 919-245-2627
3. Resolution Authorizing Sale through
Upset Bid Process
PURPOSE: To review the offer to purchase a County-owned 0.2-acre property, PIN
#9863668263, in Hillsborough and approve a resolution authorizing the sale of the property
through an upset bid process.
BACKGROUND: The County owns a 0.2-acre property, PIN #9863668263, at the intersection of
Lafayette Drive and Hardwood Drive in south Hillsborough that was acquired when the
surrounding subdivision was approved and recorded in 1983 (see Attachment 2 for a map
showing the property). The developer deeded the parcel to Orange County, but the lot was never
reserved or dedicated as a public or private right-of-way. It was common practice in the 1990s to
create these lots as "placeholders" if adjacent tracts were developed and connectivity was
needed.
While the current tax value is listed as $30,000, Orange County Tax Administrator Nancy Freeman
states that "after adjusting this unbuildable lot down 95% for size and utility, it would have a value
of $5,500 for 2025. This would seem to be a fair valuation for a property that only has value as
assemblage with one of the three contiguous parcels."
Thomas and Anthea Darling, who own property adjacent to the parcel, have submitted an offer to
the County to purchase the property for $5,000 and have submitted the required 5% deposit.
In accordance with North Carolina General Statute 160A-269, the County may receive, solicit, or
negotiate an offer to purchase County property and advertise it for upset bid. As all offers for the
purchase of County property must be presented to the Board of County Commissioners for
consideration, Attachment 3 is a resolution authorizing the sale of the property through an upset
bid process. Should the Board approve the offer for the sale of this property in this manner; a
notice of sale will immediately be placed in a local paper and on the County's Purchasing web
page. The notice shall contain a general description of the property, the amount and terms of the
offer, and a notice that within ten days any person may raise the bid by not less than ten percent
(10%) of the first one thousand dollars, and five percent (5%) of the remainder.
