46 <br /> 1 Slide #10 <br /> Staff Analysis and Recommendation <br /> The Planning Director recommends approval of the text <br /> amendments (Attachment 2), and the Statement of Approval <br /> and Consistency(Attachment 1) as being reasonable and in <br /> the public interest define, permit, and regulate "Tobacco and <br /> Hemp Retail" use as a primary land use. <br /> ORANGE COUNTY <br /> NORTH CAROLINA <br /> 2 <br /> 3 Chair Bedford asked if the reason libraries were not included because the libraries are <br /> 4 located within town limits. <br /> 5 Cy Stober said he did not know. He said the regulation could be amended should the <br /> 6 need arise. <br /> 7 Commissioner Fowler said she appreciated everyone who worked on the language. She <br /> 8 said she hopes it serves as a model for the towns within Orange County. She asked the Clerk to <br /> 9 the Board to share the language with the town clerks. <br /> 10 Commissioner Hamilton said it is an important issue. She said that other communities <br /> 11 included halfway housing and residential rehabilitation support facilities. She asked why the <br /> 12 county's proposal did not include those. <br /> 13 Cy Stober said they are uncommon uses, but they could be included with a friendly <br /> 14 amendment. He said there are group homes in Orange County. <br /> 15 Commissioner Hamilton made a friendly amendment to include those kinds of facilities. <br /> 16 Commissioner McKee seconded the friendly amendment. <br /> 17 Chair Bedford asked for the definition of those facilities. <br /> 18 Cy Stober said it would be family care facilities and group homes. <br /> 19 Chair Bedford clarified that it could be for any kind, whether it is IDD or prison release. <br /> 20 Cy Stober said it is not defined at that level in the UDO. <br /> 21 Commissioner Fowler asked if those would be included in residential. <br /> 22 Cy Stober said they are. He said that group homes are special uses in residential, so it is <br /> 23 all permitted and captured in the UDO. <br /> 24 Chair Bedford said that the friendly amendment would not be needed since it is already <br /> 25 captured in the UDO. <br /> 26 Cy Stober said yes. <br /> 27 <br /> 28 A motion was made by Commissioner McKee, seconded by Commissioner Fowler, to <br /> 29 open the public hearing. <br /> 30 <br /> 31 VOTE: UNANIMOUS <br /> 32 <br /> 33 <br />
