Attachment 6 <br /> Resolution # : RES -2024 - 048 <br /> RESOLUTION <br /> OF THE <br /> ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS <br /> Date : September 5 , 2024 <br /> Name of Subdivision : Stonewall <br /> Owner/Applicant : Kevin Currin <br /> 1050 Rhodes Gap Trail <br /> Durham , NC <br /> Cons ultants /Agent(s ) : EarthCentric Engineering <br /> 204 West Clay Street <br /> Mebane , NC <br /> The Board of County Commissioners hereby approves the Stonewall Preliminary <br /> Subdivision Plat , dated June 25 , 2024 , containing the following : <br /> • 18 lots slated for single -family residential development with a density of one ( 1 ) <br /> dwelling unit per every 2 . 02 acres of land area ; <br /> • 1 paved public roadway , tentatively named " Magpie Lane " constructed to North <br /> Carolina Department of Transportation public road standards ; <br /> • The preservation of 17 . 42 acres of Primary and Secondary open space as <br /> denoted on the Preliminary Plat ; and <br /> • A 30 -foot wide landscape buffer along Miller Road . <br /> The approval of this resolution authorizes and directs the Orange County Manager to <br /> accept for Orange County and on behalf of the public generally , the offer of dedication <br /> of all publicly offered areas/easements , including rights - of-way for the public portions of <br /> roads named " Magpie Lane " without maintenance responsibility . <br /> Per the Orange County Unified Development Ordinance ( UDO ) the applicant shall <br /> construct , maintain and /or improve all Common Open Space areas until such time as it <br /> is accepted for ownership and maintenance by a recorded Homeowner' s Association <br /> ( HOA) . <br /> Before the Final Plat of Stonewall can be approved by the Planning Department and <br /> recorded within the Orange County Registrar of Deeds office the following conditions <br /> shall be addressed : <br /> A . Declaration of Restrictions <br /> 1 . The Orange County Planning Department shall author a Declaration of <br /> Restrictions ( hereafter ` the document ' ) establishing and describing the <br /> various development restrictions , standards , conditions , and requirements <br />
