Attachment 6 Resolution # : RES -2024 - 048 RESOLUTION OF THE ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS Date : September 5 , 2024 Name of Subdivision : Stonewall Owner/Applicant : Kevin Currin 1050 Rhodes Gap Trail Durham , NC Cons ultants /Agent(s ) : EarthCentric Engineering 204 West Clay Street Mebane , NC The Board of County Commissioners hereby approves the Stonewall Preliminary Subdivision Plat , dated June 25 , 2024 , containing the following : • 18 lots slated for single -family residential development with a density of one ( 1 ) dwelling unit per every 2 . 02 acres of land area ; • 1 paved public roadway , tentatively named " Magpie Lane " constructed to North Carolina Department of Transportation public road standards ; • The preservation of 17 . 42 acres of Primary and Secondary open space as denoted on the Preliminary Plat ; and • A 30 -foot wide landscape buffer along Miller Road . The approval of this resolution authorizes and directs the Orange County Manager to accept for Orange County and on behalf of the public generally , the offer of dedication of all publicly offered areas/easements , including rights - of-way for the public portions of roads named " Magpie Lane " without maintenance responsibility . Per the Orange County Unified Development Ordinance ( UDO ) the applicant shall construct , maintain and /or improve all Common Open Space areas until such time as it is accepted for ownership and maintenance by a recorded Homeowner' s Association ( HOA) . Before the Final Plat of Stonewall can be approved by the Planning Department and recorded within the Orange County Registrar of Deeds office the following conditions shall be addressed : A . Declaration of Restrictions 1 . The Orange County Planning Department shall author a Declaration of Restrictions ( hereafter ` the document ' ) establishing and describing the various development restrictions , standards , conditions , and requirements
