io <br />Grantee's Cable System is a 750 NII-Iz hybrid fiber coaxial, two way capable system. <br />Grantee shall install and maintain the Cable System in accordatrce with industry <br />standazds arrd shall upgrade the Cable System to meet its business objectives. <br />Section 4. Service Area <br />The Grantee's Service Area shall consist of the unincorporated azeas located within the <br />County as may be amended from time to time as the result of arnrexation of territory by <br />incorporated municipalities located within the County.. <br />Section 5. Cable System Service Area Extension <br />A. The Grantee shall extend service within the County to any household where the <br />number of occupied homes, and homes for which certificates of occupancy have <br />been issued equals at least eighteen (18) homes per mile with the measurement <br />starting from the closest usable active point on the Cable System. The Grantee <br />shall apply for all necessary permits within ninety (90) days of confirmation that <br />the required density is rnet. Such extensions shall be completed within six (6) <br />months of notification and receipt of all necessary utility permits and other right <br />of way permits. The Grantor may approve additional time subject to a written <br />request by the Grantee that delineates the case for additional time. <br />B. If the number of households per mile is less than eighteen (18), the requesting <br />Customers(s) may obtain service by paying a share of the incremental cost of the <br />extension as follows: <br />The Grantee shall pay a share of costs calculated as the fraction derived <br />from the existing density as calculated above divided by eighteen (18) <br />homes per mile; requesting Customer(s)' shaze shall equal the remainder. <br />For example, if the line extension density is nine (9) homes per mile, the <br />Grantee shall pay fifty percent (50%) of the extension cost and the <br />requesting Customer(s) shall pay the remaining fifty percent (50%). <br />C. Upon receipt of a written request for a Cable Service extension from the Grantor, <br />the Grantee shall, within thirty (30) days, respond in writing with its calculation <br />of the density. If the density is less than eighteen (18) homes per mile, the <br />Grantee shall also provide a firm price good for ninety (90) days reflecting the <br />proportional share which requesting resident(s) must pay on a cost sharing basis <br />to obtain Cable Service. Within ninety (90) days from payment of the cost share <br />by prospective Customer(s) and receipt of all necessazy utility permits or other <br />Right-of--Way perniits, the Grantee shall complete the extension of Cable Service. <br />D. As the household density increases in an azea where service is extended on a cost <br />shaziug basis, the Grantee shall, upon request, annually refund a proportionate <br />share of the Customer(s)' contributions comrnensurate with the increase in <br />6 <br />
