42 <br /> <br />Revised 01/24 <br /> <br />ARTICLE 25. CONTRACTOR AND SUBCONTRACTOR RELATIONSHIPS <br /> <br />25.1 Within thirty (30) days after initial receipt of the Construction Contract for signatures the <br />Contractor shall submit to the Designer and Owner for acceptance a current list of the names of <br />Subcontractors and such other persons and organizations (including those who are to furnish <br />materials or equipment fabricated to a special design) proposed for any and all portions of the <br />Work. The Contractor shall provide this list at this time even if the Contractor was required to <br />submit a list of proposed Subcontractors with the Contractor’s bid. The Designer shall promptly <br />reply to the Contractor in writing stating whether or not the Owner or the Designer, after due <br />investigation, has objection to any such proposed person or entity or if it needs additional <br />information to evaluate the persons on the list. Failure of the Designer to reply within ten (10) <br />days after the Contractor has furnished all required information shall constitute notice of no <br />objection. <br /> <br />The Contractor shall not contract with any such proposed person or entity to whom the Owner <br />or the Designer has made reasonable objection. If the Designer or Owner has reasonable <br />objection to any such proposed person or entity, the Contractor shall submit a substitute to <br />whom the Owner and the Designer have no reasonable objection. The Contractor shall make no <br />substitution for any Subcontractor, person, or entity previously allowed without first notifying the <br />Designer and Owner in writing and no substitution may be made if the Owner or Designer <br />makes a reasonable objection to such substitution. <br /> <br />25.2 The Contractor agrees that the terms of the Contract Documents, including all portions <br />thereof, shall apply to all Subcontractors of the Contractor as if they were the Contractor, and <br />that the Subcontractors of the Contractor shall, by means of their subcontracts, be bound by all <br />the terms of the Contract Documents including, but not limited to, Article 26 of these General <br />Conditions. <br /> <br />25.3 Payments to Subcontractors shall be made in accordance with the provisions of N.C. Gen. <br />Stat. §143-134.1. <br /> <br />ARTICLE 26. USE OF PREMISES <br /> <br />26.1 The Contractor shall confine apparatus, the storage of materials, the operations of workers, <br />and the disposal of material to limits indicated by law, ordinances, permits, and directions of the <br />Designer, if any. <br /> <br />26.2 The Contractor shall not load or permit any part of the Work to be loaded with a weight that <br />will endanger its safety, intended performance, or configuration. <br /> <br />26.3 The Contractor shall enforce all of the Designer's instructions, including, but not limited to, <br />those regarding signs, advertisements, fires, and smoking. <br /> <br />ARTICLE 27. CUTTING, PATCHING AND FITTING <br /> <br />27.1 The Contractor shall do all cutting, fitting, and patching of the Work that may be required to <br />make its several parts come together properly and fit it to receive or to be received by Work <br />shown in or which can be reasonably implied from the Contract Documents. <br /> <br />Docusign Envelope ID: 687B9CC7-F1BC-43DB-A291-A8D859EFA3B2
