5.POTENTIAL BOA CONFLICT OF INTEREST STATEMENT It is the duty of every Board member to avoid both conflicts of interest and appearances of conflict. Board members having any conflicts of interest or appearances of conflict with respect to matters before the Board should identify the conflict or appearance of conflict and refrain from undue participation in the matter involved. As a reminder, NC General Statute § 160D-109 establishes the following standard: A member of any board exercising quasi-judicial functions pursuant to this Chapter shall not participate in or vote on any quasi-judicial matter in a manner that would violate affected person’s constitutional rights to an impartial decision maker. Impermissible violations of due process include, but are not limited to, a member having a fixed opinion prior to hearing the matter that is not susceptible to change, undisclosed ex parte communications, a close familial, business, or other associational relationship with an affected person, or a financial interest in the outcome of the matter. 6.CASES: A-3-24 – To review Special Use Permit (Case Number SUP24-0009) request submitted by Childs Pace Properties, LLC proposing a major modification to previously-approved Special Use Permit for a care facility. The request is to allow for an increase in students and employees at the existing day care facility. The site is located on Orange County PIN 0801-13-1208, at 735 Erwin Drive, Durham, within the Chapel Hill Township of Orange County. BA24-0001 - To review a Variance (Case Number BA24-0001) request submitted by Samuel Harrell. The applicant has applied for a variance from the 150-foot reservoir buffer to allow for the renovation and construction of an addition to the existing nonconforming residential structure +/- 75 ft. from Lake Orange. The site is located on Orange County PIN 9857-76-0674, at 4517 Eno Cemetery Road, Cedar Grove, within the Cedar Grove Township of Orange County. 7.ADJOURNMENT
