CONCLUSIONS OF THE ORANGE COUNTY BOARD OF ADJUSTMENT <br />PERTAINING TO A REQUEST SUBMITTED BY <br />CHILDS PACE PROPERTIES, LLC <br />PROPOSING A MAJOR MODIFICATION TO EXISTING SPECIAL USE PERMIT <br />ON A PARCEL OF PROPERTY LOCATED AT 735 ERWIN ROAD <br />SUP24-0009 <br />(PIN 0801-13-1208) <br />When applying the adopted Findings of Fact to the relevant Standards found in the UDO, the <br />Orange County Board of Adjustments makes the following Conclusions: <br />1.All necessary submittal requirements were met, including: <br />a.Submittal of proper forms (UDO 2.2, Finding of Fact 1); and, <br />b.Fees paid (UDO 2.2.4(D), Finding of Fact 1); and, <br />c.The use was fully described (UDO 2.5.3(F) and 2.7.3(B)(1), Finding of Fact 2-6); <br />and, <br />d.Owner Information was provided (UDO 2.7.3(B)(2), Finding of Fact 1 and 2); and, <br />e.The facilities were described (UDO 2.7.3(B)(1), Finding of Fact 2-6); and, <br />f.Access, parking, and care facility use were identified (UDO 2.5.3(F), 2.5.3(L), <br />5.8.2, Finding of Fact 2 and 16); and, <br />g. Plans were identified (UDO 2.5.3(K) and 2.7.3(B)(1), Finding of Fact 2 and 16); <br />and, <br />h.Site plans were submitted, (UDO 2.5, Finding of Fact 2 and 16); and, <br />i.A list of parcels within 1,000’ was provided (UDO 2.7.3(B)(5), Finding of Fact 2) <br />and; <br />j.Environmental Assessment was submitted (UDO 2.7.3(B)(7), Finding of Fact 2); <br />and, <br />k.Method of Debris Removal was described (UDO 2.7.3(B)(8), Finding of Fact 2); <br />and, <br />l.Development Schedule was provided (UDO 2.7.3(B)(9), Finding of Fact 2), and <br />m.Where a State license is required to operate the facility, evidence that the minimum <br />requirements to qualify for said license have been, or will be, met shall be <br />submitted. (UDO Section 5.8.2(B)(1)(a), Finding of Fact 2 and 7). <br />n.A floor plan of the proposed facility, showing the use and dimensions of each room <br />and the location of entrances and exits. (UDO Section 5.8.2(B)(1)(b), Finding of <br />Fact 2 and 8). <br />2.Proper notice was provided as required by statute and ordinance, including: <br />a.Notice was mailed for the Neighborhood Information Meeting (UDO 2.7.5(B), <br />Finding of Fact 10); and, <br />b.Signs were posted for the Neighborhood Information Meeting (UDO 2.7.5(D), <br />Finding of Fact 12); and, <br />c. Notice was mailed for the Evidentiary Hearing (UDO 2.7.6(A)(1), Finding of Fact <br />11); and, <br />d.Signs were posted for the Evidentiary Hearing (UDO 2.7.6(A)(2), Finding of Fact <br />12). <br />3.Waste, Safety and Access requirements were met, including: <br />a.The method and adequacy of providing for sewage disposal facilities, solid waste <br />and water service is sufficient for the proposed use (UDO 5.3.2(B)(1), Finding of <br />Fact 2 and 13); and, <br />Attachment 6C <br />195
