FINDINGS OF FACT <br />BY THE ORANGE COUNTY BOARD OF ADJUSTMENT <br />PERTAINING TO A REQUEST SUBMITTED BY <br />CHILDS PACE PROPERTIES, LLC <br />PROPOSING A MAJOR MODIFICATION TO EXISTING SPECIAL USE PERMIT <br />ON A PARCEL OF PROPERTY LOCATED AT 735 ERWIN ROAD <br />SUP24-0009 <br />(PIN 0801-13-1208) <br />Based upon the competent, material and substantial evidence received at the evidentiary hearing, <br />the Board of Adjustments gave each piece of evidence its due weight and makes the following <br />Findings of Fact: <br />Application Components <br />1.Childs Pace Properties, LLC filed an application for a Special Use Permit (SUP) Major <br />Modification related to Orange County PIN 0801-13-1208 on April 17, 2024 for Use # 19, <br />Care Facility with a fee paid. <br />2.The application included an amended site plan, written narrative outlining the specific <br />changes requested, and attachments as included in the agenda materials received by the <br />BOA, specifically: Attachment 1. <br />3.The existing buildings on the property include: The parcel includes an existing single- <br />family home, barn, and three additional accessory structures. The barn and accessory <br />structures shall not be utilized for the care facility use. <br />4.The proposed buildings include: No structures are proposed. <br />5.The access, parking, and care facility include: The project will be utilizing the existing <br />ingress/egress on Erwin Road. Access on the site is proposed via a 20 ft. wide gravel <br />driveway. Parking requirements are met. <br />6.The landscaping includes: Existing vegetation is located along the perimeter of the site. <br />7.Where a State license is required to operate the facility, evidence that the minimum <br />requirements to qualify for said license have been, or will be, met shall be submitted: <br />The applicant has provided the required license as part of the application package <br />(Attachment 1). <br />8.A floor plan of the proposed facility, showing the use and dimensions of each room and <br />the location of entrances and exits: The applicant has provided the required floor plan as <br />part of the application package (Attachment 1). <br />9.Ashley Moncado, a member of the Orange County Planning & Inspections Department <br />staff, provided sworn testimony regarding receipt of the following: 10 copies of site plans, <br />a list of parcels within 1,000 feet, 10 copies of Environmental Assessment, method of <br />debris disposal, and development schedule. <br />Notice Requirements <br />10.Notices of a Neighborhood Information Meeting were mailed on May 6, 2024 by the <br />applicant and the meeting was held on May 20, 2024. <br />11.Notices of the BOA Evidentiary Hearing were mailed on July 10, 2024 and the meeting <br />held on July 24, 2024. <br />12.Signs were posted on May 6, 2024 for the Neighborhood Information Meeting and on July <br />9, 2024 for the Evidentiary Hearing. <br />Waste, Safety & Access <br />13.The waste disposal methods were reviewed by Victoria Hudson, Environmental Health <br />Director with the Orange County Environmental Health Department, and Matthew Taylor, <br />Attachment 6B <br />192
