Staff Analysis <br />Compliance with Unified Development Ordinance <br />Staff review determined that the application is complete and all submitted materials are in compliance <br />with the following applicable sections of the UDO: <br /> Section 2.7, Special Use Permits <br /> Section 5.2, Table of Permitted Uses <br /> Section 5.3.2, Application of Use Standards, Special Uses <br /> Section 5.8.2, Care Facility <br />“Care Facility” is identified as Use 19 in the Table of Permitted Uses. Section 5.2.1: Table of Permitted <br />Uses of the UDO lists Care Facility as a permitted use of property within the RB general use zoning <br />district subject to the issuance of a Special Use Permit. <br />Standards governing the development of “Care Facility”, as detailed in Section 5.8.2 of the UDO, are as <br />follows: <br />(1) Submittal Requirements <br />In addition to the information required by Section 2.7 or 2.9, as applicable, the following shall be <br />submitted as part of the application: <br /> <br />(a) Where a State license is required to operate the facility, evidence that the minimum <br />requirements to qualify for said license have been, or will be, met shall be submitted. <br /> <br />Staff Comment: The applicant has provided the required license as part of the <br />application package (Attachment 1). <br /> <br />(b) A floor plan of the proposed facility, showing the use and dimensions of each room <br />and the location of entrances and exits. <br /> <br />Staff Comment: The applicant has provided the required floor plan as part of the <br />application package (Attachment 1). <br /> <br />(2) Standards of Evaluation <br /> <br />(b) Facilities involving the care of children and adolescents shall be located in an area <br />which is free from conditions dangerous to the physical and moral welfare of the <br />children. <br /> <br />Staff Comment: The proposed expansion to the existing facility has been reviewed <br />by Orange County DAC including Planning, Building Inspections, NCDOT, <br />Environmental Health, Solid Waste, and Emergency Services for compliance with <br />Orange County Ordinances, State Building Code, Health Code, and Fire Code. <br /> <br />(a) Where a State license is required to operate the facility, the applicant shall <br />demonstrate the minimum requirements to qualify for said license are satisfied. <br /> <br />Staff Comment: The applicant has provided the required license as part of the <br />application package (Attachment 1). <br /> <br />(c) There is direct frontage and access on a public State-maintained road. <br /> <br />123
