eliminates a requirement from the applicant to provide a more detailed Environmental Impact Statement <br />(EIS) process as outlined in Sections 2.25.2 and 6.16.4 of the UDO. <br /> <br />Proposed Conditions <br />The following conditions of approval are being submitted by staff. These conditions include conditions of <br />approval contained in the existing SUP approved in 2002. <br />1. The facility shall meet all applicable requirements of the State of North Carolina Building Code. <br /> <br />2. Within ninety (90) days from the beginning of operation of the day care facility, all requirements to <br />obtain a State of North Carolina Day Care License must be met. <br /> <br />3. Any proposed sign for the day care facility shall meet current standards of the Orange County <br />Unified Development Ordinance. <br /> <br />4. Any zoning violations on the site shall be corrected prior to the issuance of a Certificate of <br />Occupancy for the facility. <br /> <br />5. The care facility shall be reviewed annually by the Planning Director to ensure compliance with <br />the standards of evaluation for such facilities and any conditions attached to the application by <br />the Board of Adjustment. Any change in the operation of the facility, which deviates from the <br />original standards and conditions, will constitute a modification and will require the approval of the <br />Board of Adjustment. In determining whether a change in the operation of the facility has <br />occurred, the Planning Director shall be guided by the procedures and criteria contained in <br />Sections 2.7.14 and 5.8.2(B). <br /> <br />6. The applicant, prior to the release of the Special Use Permit, shall submit a letter regarding <br />adequacy of police protection regarding the day care facility. <br /> <br />7. The applicant shall obtain a Driveway Permit from the North Carolina Department of <br />Transportation (NCDOT) prior to the issuance of a Certificate of Occupancy for the use. <br /> <br />8. The Special Use Permit shall only affect the portion of the property located within Orange <br />County's Zoning Jurisdiction. The Special Use Permit shall not affect the portion of the property <br />located in Durham County. Subsequently, no portion of the property located in Durham County <br />shall be used for the approved Special Use. <br /> <br />9. Per Section 2.5 of the UDO, the applicant shall obtain all necessary development permits from <br />the County prior to the initiation of any land disturbing activity associated with the construction of <br />the proposed use included, but not limited to: Building Permit, Land Disturbance Permit, Solid <br />Waste Management Permit, and Zoning Compliance Permit. <br /> <br />10. In accordance with the provisions of Section 2.7.11(C) of the UDO, if any condition of this Special <br />Use Permit is held invalid or void, then the Special Use Permit itself shall be held invalid or void in <br />its entirety and of no effect. <br />Solid Waste <br />The applicant has indicated development within the project will conform to the Orange County Solid <br />Waste Management Ordinance. Attachment 5 includes Development Advisory Committee comments <br />from Orange County Solid Waste staff. <br /> <br />121
