This amendment is in response to a petition made by the BOCC and was <br /> 511 reviewed at the April 3, 2024 ORC meeting. It is scheduled for BOCC public hearing on June 4, 2024. <br /> 512 <br /> 513 PRESENTER: CY STOBER, PLANNING DIRECTOR. <br /> 514 <br /> 515 Cy Stober: I'm pleased to be here this evening to present two Text Amendments. I'm happy to talk to <br /> 516 before we close about the third one that the Ordinance Review Committee reviewed last month. We are still <br /> 517 working on that, but I can provide an update on that. I am pleased to present this evening the UDO Text <br /> 518 Amendment to permit, define, and regulate tobacco and hemp retail uses. I'll acknowledge, I have underserved <br /> 519 you. I don't have a process slide at the beginning of my presentation. I got lazy because I brought this to the <br /> 520 ORC last month and nearly all of you were at that meeting, so just a reminder of your responsibilities tonight are <br /> 521 to consider the Text Amendment before you to discuss it and then to make a recommendation to the Board if <br /> 522 you're prepared. There is an option for you to continue the discussion to a later meeting if you'd like. Those are <br /> 523 your options this evening. <br /> 524 <br /> 525 Mr. Stober overviewed the definition of Tomacco and Hemp Retail Uses, referencing the presentation provided <br /> 526 to the Ordinance Review Committee. <br /> 527 <br /> 528 Lamar Proctor: You said the proposed change would put this as a Conditional Use? So it wouldn't So, a <br /> 529 permitted use by right of, in any zoning district? <br /> 530 <br /> 531 Cy Stober: Correct. <br /> 532 <br /> 533 Lamar Proctor: So existing uses would be grandfathered in if they already exist? <br /> 534 <br /> 535 Cy Stober: Correct. <br /> 536 <br /> 537 Lamar Proctor: And if you wanted to do a new hemp stores or whatever,vape shop,you would have to do a <br /> 538 conditional zoning application? <br /> 539 <br /> 540 Cy Stober: Mm hmm. <br /> 541 <br /> 542 Chris Johnston: And if you wanted to make any changes to your existing hemp shop you'd have to become <br /> 543 in compliance, which means you'd have to come before— <br /> 544 <br /> 545 Cy Stober: That's correct, so you'd be regulated by Article 8 of the UDO which is non-conforming uses, <br /> 546 and you'd have to bring it into zoning conformance, so you'd have to go through the public hearing. <br /> 547 <br />
