2 <br /> • Fourth Action — The BOCC reviews and takes action on the Preliminary Plat <br /> application. <br /> • Fifth Action — Per UDO Section 2.15.4, once all construction activities are completed, <br /> or appropriate performance guarantees are approved, the Planning Director shall take <br /> action on an application solely to affirm conformity with all applicable regulations and <br /> any established conditions, and approve the recordation of a Final Plat, allowing for <br /> the individual lots to be created. <br /> The Preliminary Plat application was provided to the State Clearinghouse for courtesy review on <br /> February 8, 2024. Planning staff reviewed the State Clearinghouse comments, as they pertain to the <br /> Major Subdivision project area, and did not identify areas of significant concern. <br /> Proposal: The applicant has submitted a Preliminary Plat (Attachment 1) to develop 15 single-family <br /> residential lots with approximately 35% (+/-9.95 acres) of dedicated open space, consistent with the <br /> open space requirements for a flexible development subdivision. The plat is compliant with all <br /> Orange County UDO's subdivision standards, and no objection or comment was identified by the <br /> DAC to the Preliminary Plat's approval (Attachment 4). Additional information and staff analysis <br /> regarding the proposal is contained in Attachment 2. <br /> Planning Board Recommendation: <br /> The Planning Board received and reviewed the Preliminary Plat application at its April 3, 2024, <br /> meeting and voted 8-1 to recommend approval of the preliminary plat (Attachment 1). Excerpts <br /> of the minutes from the meeting are included in Attachment 5. Agenda materials from the <br /> meeting can be viewed at: <br /> https://www.orangecountVnc.gov/AgendaCenter/ViewFile/Agenda/ 04032024-1983 <br /> Planning Director's Recommendation: <br /> The Planning Director recommends that the Board of County Commissioners: <br /> 1) Consider the matter for action; <br /> 2) Review the staff report (Attachment 2), featuring analyses of UDO compliance and <br /> consistency of the application with Orange County's adopted plans; <br /> 3) Receive the Preliminary Plat application, and <br /> 4) Approve the Preliminary Plat, as submitted. <br /> FINANCIAL IMPACT: This request has been reviewed by various County departments which <br /> have determined that the approval of the request would not create the need for additional <br /> funding for the provision of County services. <br /> SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to <br /> this item: <br /> • GOAL: ESTABLISH SUSTAINABLE AND EQUITABLE LAND-USE AND <br /> ENVIRONMENTAL POLICIES <br /> The fair treatment and meaningful involvement of people of all races, cultures, incomes <br /> and educational levels with respect to the development and enforcement of <br /> environmental laws, regulations, policies, and decisions. Fair treatment means that no <br /> group of people should bear a disproportionate share of the negative environmental <br /> consequences resulting from industrial, governmental and commercial operations or <br /> policies. <br />
