<br />25% Material Mobilization due at approval, 25% due at commencement, and 50%
<br />due net 30 days after completion.
<br />Contractor's Liability and Warranty - Sundek of NC is responsible for the
<br />completion of work in compliance with contract documents and for quality of
<br />material and workmanship in accordance with standard specifications. Due to the
<br />inherent movement in concrete, soil, and wooden structures, and the possible lack
<br />of structural integrity of these substrates, no guarantee, either expressed or
<br />implied is granted concerning cracks in Sundek. Contractor is not liable for any
<br />drainage improvements or surface runoff causing inadequate drainage.
<br />Contractor is not responsible for mastic or clearcoat bubbling. Contractor is not
<br />responsible for delay or damages due to fire, accident, weather, soil or subsoil
<br />conditions, or other causes beyond the contractor's reasonable control. However,
<br />during the application, the contractor accepts full responsibility for any weather
<br />damage. Work shall be considered commenced when the crew arrives to begin
<br />preparation work.
<br />I accept the fact that all colors are as specified. A slight differentiation will be seen
<br />in the transition to textured material. Colors may also vary slightly by being a
<br />shade lighter or darker, from natural coloring. If, after the application of the color
<br />(stain, dye, finish coat, epoxy, etc.), I am displeased for whatever reason, I accept
<br />full responsibility for my choice and will pay all necessary charges to change the
<br />color. I, further hold Sundek of North Carolina completely harmless for the choice
<br />of and/or the acceptance of the color of my Sundek of North Carolina surface.
<br />Color mottling and variations together with texture irregularities are intended to
<br />enhance the finished SunStain/SunAcid/SunDye/SunOne/SunCanvas products.
<br />Each SunStain/SunAcid/SunDye/SunOne/SunCanvas project is a custom creation
<br />and is unique in its color and texture characteristics. Sundek of North Carolina will
<br />strive to achieve the color and texture desired by the client however Sundek of
<br />North Carolina makes NO GUARANTEE that the color or texture will produce the
<br />same uniformity and consistency of manufactured masonry products.
<br />Sundek of NC hereby grants the owner a 2-year guarantee against defective
<br />material or workmanship, i.e., bond failure, including flaking or peeling of the
<br />application. It does not cover mastic, defects, or failures caused by obvious
<br />neglect or improper maintenance.
<br />Owner agrees to furnish all water and electricity necessary for the installation of
<br />Sundek and agrees to remove or protect all personal property on the area to be
<br />resurfaced. Contractor shall not be held responsible for removal and replacement
<br />of or damage to said items. Additionally, it is the owner's responsibility to protect
<br />the working area from water damage from sprinklers, pets, children, servicemen,
<br />etc. during application.
<br />In the event the contractor shall employ an attorney or bring suit to enforce any of
<br />the terms or conditions of this agreement, in addition to his claim, the contractor
<br />shall be entitled to reasonable attorney's fees and expenses of litigation. All
<br />delinquent accounts shall bear interest at 1.5% per month.
<br />This document contains the entire agreement of the parties, including all pre-
<br />contract negotiations and understandings, and its execution binds all parties
<br />signing it, jointly and severally. As well as their respective heirs, representatives,
<br />successors, and assigns. This contract is not transferable.
<br />The undersigned acknowledges receipt of a copy of this contract. The above
<br />prices, specifications, and conditions (or attached plans) are satisfactory and are
<br />hereby accepted.
<br />This proposal may be withdrawn by contractor if not accepted within 90 days.
<br />Notice of Cancellation
<br />You may cancel this transaction, without any penalty or obligation. If you cancel,
<br />any property traded in, any payment.
<br />made by you under contract or sale, and any negotiable instrument executed by
<br />you will be returned within 10 business days following receipt by the seller of your
<br />cancellation notice, and any security interest arising out of the transaction will be
<br />canceled.
