85 <br /> Staff Analysis <br /> Compliance with Unified Development Ordinance <br /> Staff review determined that the application is complete and all submitted materials are in compliance <br /> with the following applicable sections of the UDO: <br /> ■ Section 2.7, Special Use Permits <br /> ■ Section 5.2, Table of Permitted Uses <br /> ■ Section 5.3.2, Application of Use Standards, Special Uses <br /> ■ Section 5.6.2, Cemetery <br /> "Cemetery" is identified as Use 62(C) in the Table of Permitted Uses. Section 5.2.1: Table of Permitted <br /> Uses of the UDO lists Cemetery as a permitted use of property within the RB general use zoning <br /> district subject to the issuance of a Special Use Permit. <br /> Standards governing the development of "Cemetery", as detailed in Section 5.6.2 of the UDO, are as <br /> follows: <br /> (1) Submittal Requirements <br /> In addition to the information required by Section 2.7 or 2.9, as applicable, the following shall be <br /> submitted as part of the application: <br /> (a) Evidence that the requirements of the North Carolina General Statutes Chapter 65 <br /> can be achieved and that the standards of the N.C, Cemetery Commission shall be met. <br /> Staff Comment: Cemeteries owned and operated by churches are exempt from <br /> standards contained in Chapter 65 of the North Carolina General Statutes. <br /> (2) Standards of Evaluation <br /> (a) A minimum lot size of two acres is provided. <br /> Staff Comment: The project meets the minimum lot areas of 2 acres; the Special Use <br /> Permit is being requested for +/-6.59 acres, as indicated on the site plan. <br /> (b) The site shall have direct access to a collector or arterial street. <br /> Staff Comment: The site has direct access to Jones Ferry Road, which is classified as <br /> a minor collector road by the NCDOT. <br /> (c) There shall be adequate space within the site for the parking and maneuvering of <br /> funeral cartilages. <br /> Staff Comment: The site plan proposes to extend the existing gravel driveway, which <br /> varies in width from 12 to 16 feet. The proposed configuration shall provide adequate <br /> space for parking and maneuvering of funeral cartilages and emergency vehicles. <br /> (d) No interments shall take place within 30 feet of any lot line. <br /> Staff Comment: The site plan provides for a 30-foot burial setback and all proposed <br /> burial plots meet the setback standard. No burials shall occur within this setback area. <br /> The applicant provided a description of the proposed use and site plan as part of the application packet <br /> (Attachment 1). The site plan identifies all elements required by the above listed UDO sections. The <br /> application packet also includes a landscape and tree protection plan which staff determines to be <br /> compliant with Article 6 of the UDO. <br /> The applicant has provided a basic environmental assessment as part of this submittal. Staff has <br /> reviewed and determined no significant environmental impact is expected from this project based on <br /> existing conditions. A Finding of No Significant Impact is available in Attachment 5 of case materials <br /> presented to the Board. <br />
