70 <br /> EXHIBIT D <br /> SPECIAL USE PERMIT APPLICATION FOR ADDITIONAL GRAVE SITES AT THE <br /> JUDEA REFORM CONGREGATION CEMETERY <br /> Applicant's Statement of Compliance <br /> The following information provides evidence to support the required findings for approval of a <br /> Special Use Permit as listed in the Orange County Unified Development Ordinance, Article <br /> 5.3.2(A)(2): <br /> Finding # 1: The use will maintain or promote the public health, safety, and general <br /> welfare, if located where proposed and developed and operated according to the plan as <br /> submitted. <br /> As described below under Specific Standards and in the drawings included in this application, <br /> the proposal complies with and conforms to applicable laws, regulations, etc. that were <br /> designed to achieve this public health, safety, and general welfare objective. This finding is <br /> supported by the safety and design elements of the physical facility; the applicant's 40 years of <br /> experience operating the existing cemetery safely and in harmony with neighboring uses; and <br /> the provision of adequate space for funeral parking; negligible impact on traffic generation <br /> (typically fewer than 30 vehicles per funeral), with virtually all services held during midday non- <br /> rush-hour periods. The existing and proposed use fulfills a range of important practical and <br /> spiritual needs of the community. <br /> Finding # 2: The use will maintain or enhance the value of contiguous property. <br /> The Owner considers this finding to be satisfied per the written testimony of a local real estate <br /> expert as presented in Exhibit C-2. <br /> Finding # 3: The location and character of the use, if developed according to the plan <br /> submitted, will be in harmony with the area in which it is to be located;and the use is in <br /> compliance with the plan for the physical development of the County as embodied in <br /> these regulations (UDO) or in the Comprehensive Plan, or portion thereof, adopted by the <br /> Board of County Commissioners. <br /> A cemetery is widely understood to be harmonious with rural residential character, and the 40- <br /> year presence of the existing cemetery has become an inherent element of its rural Orange <br /> County neighborhood. As such, the measured and responsible addition of new grave sites as <br /> proposed in this application will remain consistent with that existing character. <br /> The allowance of a cemetery as a permitted use in Orange County's Rural Buffer (RB) zoning <br /> district, subject to the protection provided by Special Use Permit review, is inherent evidence <br /> that this use complies with the County's plans for physical development. <br /> 1 <br />
