CONCLUSIONS OF THE ORANGE COUNTY BOARD OF ADJUSTMENT <br />PERTAINING TO A REQUEST SUBMITTED BY <br />CAPKOV VENTURES, INC. PROPOSING A MAJOR MODIFICATION <br />TO EXISTING SPECIAL USE PERMITS ON PARCELS <br />9873-41-0172 AND 9872-49-0872 FOR WOODSEDGE AND THE WOODS MOBILE HOME <br />PARK <br />When applying the adopted Findings of Fact to the relevant Standards found in the UDO, the <br />Orange County Board of Adjustments makes the following Conclusions: <br />1.All necessary submittal requirements were met, including: <br />a.Submittal of proper forms (UDO 2.2, Finding of Fact 1); and, <br />b.Fees paid (UDO 2.2.4(D), Finding of Fact 1); and, <br />c.An amended site plan and written narrative outlining the specific changes being <br />requested (UDO 2.7.14, Finding of Fact 1, 2, 3 and 4) <br />2.Proper notice was provided as required by statute and ordinance, including: <br />a.Notice was mailed for the Neighborhood Information Meeting (UDO 2.7.5(B) and <br />(C), Finding of Fact 5); and, <br />b.Signs were posted for the Neighborhood Information Meeting (UDO 2.7.5(D), <br />Finding of Fact 7); and, <br />c. Notice was mailed for the Evidentiary Hearing (UDO 2.7.6(A)(1), Finding of Fact <br />6); and, <br />d.Signs were posted for the Evidentiary Hearing (UDO 2.7.6(A)(2), Finding of Fact <br />11). <br />3.Waste, Safety and Access requirements were met, including: <br />a.The method and adequacy of providing for sewage disposal facilities, solid waste <br />and water service is sufficient for the proposed use (UDO 5.3.2(B)(1), Finding of <br />Fact 8); and, <br />b.The method and adequacy of police fire and rescue squad protection is sufficient <br />for the proposed use (UDO 5.3.2(B)(2), Finding of Fact 9); and, <br />c.The method and adequacy of vehicle access to the site and traffic conditions <br />around the site are sufficient for the proposed use (UDO 5.3.2(B)(3), Finding of <br />Fact 10). <br />4.Standards specific to Planning of Common Open Space, including: <br />a.Planning for open space shall always prominently meet at least three of the <br />following three goals: the maintenance of wildlife corridors and/or habitat, the <br />preservation of rural character, and the creation or protection of space for outdoor <br />recreation (UDO Section 7.12.4, Find of Fact 11). <br />5.General welfare, value and harmony standards applicable to all SUPs have been met, <br />including: <br />a.The use will maintain or promote the public health, safety and general welfare, if <br />located where proposed and developed and operated according to the plan as <br />submitted (UDO 5.3.2(A)(2)(a), Finding of Fact 13); and, <br />b.The use will maintain or enhance the value of contiguous property (UDO <br />5.3.2(A)(2)(b), Finding of Fact 12); and, <br />c.The location and character of the use, if developed according to the plan <br />submitted, will be in harmony with the area in which it is to be located and the use <br />is in compliance with the plan for the physical development of the County as <br />embodied in these regulations or in the Comprehensive Plan, or portion thereof, <br />adopted by the Board of County Commissioners (UDO 5.3.2(A)(2)(c), Finding of <br />Fact 14). <br />265 <br />Attachment 6c
